The 2010-2025 MHz Frequency Band (Management) Regulations 2016

The Secretary of State makes the following Regulations in exercise of the powers conferred by section 2(2) of the European Communities Act 19721. The Secretary of State is a minister designated2 for the purposes of that section in relation to electronic communications.

Citation and commencement1.

These Regulation may be cited as the 2010-2025 MHz Frequency Band (Management) Regulations 2016 and come into force on 29th September 2016.

Designation of the 2010-2025 MHz frequency band2.

(1)

OFCOM must designate and make available, on a non-exclusive basis, the band for video PMSE, in accordance with the parameters set out in the Annex to the Decision.

(2)

OFCOM must keep the use of the band under scrutiny so that the United Kingdom may report any findings to the Commission in accordance with Article 4 of the Decision.

(3)

Upon detection of interference to other types of spectrum users or services that are entitled to use the band on 10th September 2016, OFCOM may restrict the use of video PMSE in the relevant portion of the band in specific geographic areas in accordance with the Annex to the Decision.

In this regulation—

“the Decision” means Commission Implementing Decision (EU) 2016/339 on the harmonisation of the 2010-2025 MHz frequency band for portable or mobile wireless video links and cordless cameras used for programme making and special events3;
OFCOM” means the Office of Communications as established by section 1 of the Office of Communications Act 20024;

“the band” means the 2010-2025 MHz frequency band;

“video PMSE” means wireless video links that can be portable or mobile and cordless cameras, used for programme making and special events.

EXPLANATORY NOTE
(This note is not part of the Regulations)

These Regulations implement Commission Implementing Decision (EU) 2016/339 of 8 March 2016 on the harmonisation of the 2010-2025 MHz frequency band for portable or mobile wireless video links and cordless cameras used for programme making and special events (OJ No L 63, 10.3.2016, p. 5).

Regulation 2(1) provides that OFCOM must make available the 2010-2025 MHz frequency band for video PMSE (as defined in regulation 2(3)) in accordance with certain parameters.

Regulation 2(2) provides that OFCOM must keep the use of the band under scrutiny.

Regulation 2(3) provides that OFCOM may restrict the use of video PMSE in the 2010-2025 MHz frequency band in certain circumstances.

A full impact assessment has not been produced for these Regulations as no impact on the private, voluntary or public sectors is foreseen.
