<Text>The Port of Tyne Authority have applied in accordance with section 14(2)(a) of the Harbours Act 1964<FootnoteRef Ref="f00001"/> (“the Act”) for a harbour revision order under section 14.</Text></P>
<P>
<Text>The Secretary of State, as the appropriate Minister for the purposes of section 14, has by an order<FootnoteRef Ref="f00002"/> under section 42A of the Act<FootnoteRef Ref="f00003"/> delegated the functions of the appropriate Minister under section 14<FootnoteRef Ref="f00004"/> to the Marine Management Organisation<FootnoteRef Ref="f00005"/>.</Text></P>

<Text>The Marine Management Organisation, being satisfied as mentioned in section 14(2)(b) and in exercise of the powers conferred by section 14(1) makes the following Order.</Text></Para>

<Title>Interpretation</Title>

<Text>In this Order—</Text>

<Para><Text>“the <Abbreviation Expansion="Port of Tyne Reorganisation Scheme 1967 confirmed by the Port of Tyne Reorganisation Scheme 1967 Confirmation Order 1968 (S.I. 1968/942)">1967 Scheme</Abbreviation>” means the Port of Tyne Reorganisation Scheme 1967 confirmed by the Port of Tyne Reorganisation Scheme 1967 Confirmation Order 1968<FootnoteRef Ref="f00006"/>; and</Text>

<Title>Amendment of 1974 Order</Title>

<Text>For article 4(2) of the 1974 Order there is substituted –</Text>

<P2para><Text>A member appointed by the Secretary of State under article 3(1)(a) shall, unless appointed to fill a casual vacancy and subject to the provisions of Schedule 1 to the 1967 Scheme, hold office for a period of 3 years following his appointment or for such lesser period as the Secretary of State may specify.</Text>

<Pnumber>3</Pnumber>
<P2para><Text>A casual vacancy arising in the office of chairman or other member appointed by the Secretary of State under article 3(1)(a) shall, unless it is not reasonably practicable to do so, be filled by the appointment of a chairman or, as the case may be, other member by the Secretary of State.</Text>

<Pnumber>4</Pnumber>
<P2para><Text>The Secretary of State may fill a casual vacancy in the office of chairman by appointing as the chairman a person who is already a member appointed under article 3(1)(a) and, if the Secretary of State does so, the appointment shall be deemed to create a casual vacancy in the office of the member who is appointed as the chairman.</Text>

<Pnumber>5</Pnumber>
<P2para><Text>A member appointed to fill a casual vacancy shall, subject to the provisions of Schedule 1 to the 1967 Scheme, hold office during the remainder of the term for which the member whom he replaces was appointed or such other period (not exceeding 3 years) as the Secretary of State may specify.</Text>
