The Port of Tyne Harbour Revision Order 2016

Coming into force
The Port of Tyne Authority have applied in accordance with section 14(2)(a) of the Harbours Act 19641 (“the Act”) for a harbour revision order under section 14.
The Secretary of State, as the appropriate Minister for the purposes of section 14, has by an order2 under section 42A of the Act3 delegated the functions of the appropriate Minister under section 144 to the Marine Management Organisation5.
The Marine Management Organisation, being satisfied as mentioned in section 14(2)(b) and in exercise of the powers conferred by section 14(1) makes the following Order.
Citation and commencement1

This Order may be cited as the Port of Tyne Harbour Revision Order 2016 and will come into force on 27th September 2016.

The Port of Tyne Acts and Orders 1968 to 2008 and this Order may be cited together as the Port of Tyne Acts and Orders 1968 to 2016.
Interpretation2
Amendment of 1974 Order3
For article 4(2) of the 1974 Order there is substituted –

A member appointed by the Secretary of State under article 3(1)(a) shall, unless appointed to fill a casual vacancy and subject to the provisions of Schedule 1 to the 1967 Scheme, hold office for a period of 3 years following his appointment or for such lesser period as the Secretary of State may specify.

A casual vacancy arising in the office of chairman or other member appointed by the Secretary of State under article 3(1)(a) shall, unless it is not reasonably practicable to do so, be filled by the appointment of a chairman or, as the case may be, other member by the Secretary of State.

The Secretary of State may fill a casual vacancy in the office of chairman by appointing as the chairman a person who is already a member appointed under article 3(1)(a) and, if the Secretary of State does so, the appointment shall be deemed to create a casual vacancy in the office of the member who is appointed as the chairman.

A member appointed to fill a casual vacancy shall, subject to the provisions of Schedule 1 to the 1967 Scheme, hold office during the remainder of the term for which the member whom he replaces was appointed or such other period (not exceeding 3 years) as the Secretary of State may specify.
Revocations4
Paragraphs 7 and 9 of Schedule 1 to the 1967 Scheme are revoked.
