<Text>The Secretary of State makes the following Order in exercise of the powers conferred by section 107A of, and paragraph 3 of Schedule 5B to, the Local Democracy, Economic Development and Construction Act 2009<FootnoteRef Ref="f00001"/>.</Text></P>
<P>
<Text>The Barnsley, Doncaster, Rotherham and Sheffield Combined Authority and councils whose local government areas are within that Combined Authority have consented to the making of this Order<FootnoteRef Ref="f00002"/>.</Text></P>
<P>
<Text>A draft of this instrument has been laid before, and approved by a resolution of, each House of Parliament pursuant to section 117(2) of the Local Democracy, Economic Development and Construction Act 2009.</Text></P>

Ref="key-b7b8833823de7aa731a6d171627082a5"/>1</Pnumber><P1para><Text>This Order may be cited as the Barnsley, Doncaster, Rotherham and Sheffield Combined Authority (Election of Mayor) Order 2016 and shall come into force on the day after the day on which it is made.</Text></P1para></P1></P1group><P1group RestrictStartDate="2016-07-22" RestrictExtent="E+W"><Title>Interpretation</Title><P1 Ref="key-1ae7c55ed57a3635586a47c7eac82930"/>2</Pnumber><P1para><Text>In this Order—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“the area” means the area of the Barnsley, Doncaster, Rotherham and Sheffield Combined Authority<FootnoteRef Ref="f00003"/>;</Text></Para></ListItem><ListItem><Para><Text>“the ordinary day of election”, in relation to any year, means the day which is the ordinary day of election in that year of councillors for counties in England and districts in accordance with sections 37 and 37A of the Representation of the People Act 1983<FootnoteRef Ref="f00004"/>.</Text></Para></ListItem></UnorderedList></P1para></P1></P1group><P1group RestrictStartDate="2024-03-21" RestrictExtent="E+W"><Title>Election of a mayor</Title><P1 election for the return of a mayor for the area is to take place on  <Substitution ChangeId="key-bd044357dc665c9e2af3f23bf30fe57c-1759473656844" CommentaryRef="key-bd044357dc665c9e2af3f23bf30fe57c">3rd May 2018</Substitution>.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2016/800/article/3/3" IdURI="http://www.legislation.gov.uk/id/uksi/2016/800/article/3/3" id="article-3-3"><Pnumber>3</Pnumber><P2para><Text> <Substitution ChangeId="key-56b16157a47d86adbace1b9a0dcf7f0e-1759473893182" CommentaryRef="key-56b16157a47d86adbace1b9a0dcf7f0e">Subject to paragraphs (5) and (6), subsequent</Substitution>  elections for the return of a mayor for the area shall take place—</Text><P3 id="article-3-4-a"><Pnumber>a</Pnumber><P3para><Text>begins with the fourth day after the day of the poll at the election for the return of a mayor for the area, and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2016/800/article/3/4/b" IdURI="http://www.legislation.gov.uk/id/uksi/2016/800/article/3/4/b" id="article-3-4-b"><Pnumber>b</Pnumber><P3para><Text>ends with the third day after the day of the poll at the next election for the return of a mayor for the area.</Text></P3para></P3></P2para></P2><P2 the ordinary day of election in 2026 is to be held instead on the ordinary day of election in 2024; and the mayor’s term is reduced accordingly.</Addition></Text></P2para></P2><P2 <P><Text>Part 6 of the Local Democracy, Economic Development and Construction Act 2009 (“the <Abbreviation Expansion="Local Democracy, Economic Development and Construction Act 2009 c. 20">2009 Act</Abbreviation>”) provides for the establishment of combined authorities for the areas of two or more local authorities in England. Combined authorities are bodies corporate which may be given power to exercise specified functions.</Text></P>
<P><Text>Under sections 107A(1) and 107B(3) of the 2009 Act the Secretary of State may provide for there to be a mayor for the area of a combined authority with the consent of the constituent councils of the combined authority (each district council or county council whose area is within the area of the combined authority) and any existing combined authority. Paragraph 3 of Schedule 5B to the 2009 Act provides that the Secretary of State may make provision for the dates on which and years in which mayoral elections for the area of a combined authority may or must take place, the intervals between elections for the return of a mayor and the term of office of a mayor.</Text></P>
<P><Text><Emphasis>Article 3</Emphasis> of the Order creates the position of mayor for the area of the Barnsley, Doncaster, Rotherham and Sheffield Combined Authority. Article 3 further specifies the term of office for the mayor for the area of the Barnsley, Doncaster, Rotherham and Sheffield Combined Authority, and the dates on which elections for the return of a mayor shall take place and the intervals between elections.</Text></P>
<P><Text>A full regulatory impact assessment has not been prepared as this instrument will have no impact on the costs of business and the voluntary sector.</Text></P>
