in relation to a road vehicle, a person who holds, or is required to hold by law, a licence for the use of that vehicle for the carriage of goods on a road; or, where no such licence is required, the keeper of the vehicle;

in relation to any other mode of transport or a berth, the person who has operational control of it for the time being.
