Proceedings for an offence under this Part may be instituted—
a
in England and Wales only by the FCA or by or with the consent of the Director of Public Prosecutions; or
b
in Northern Ireland only by the FCA or by or with the consent of the Director of Public Prosecutions for Northern Ireland.
