<Text>The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 365(1) and (4), 368 and 402 of the Communications Act 2003<FootnoteRef Ref="f00001"/>, as extended by the Communications (Jersey) Order 2003<FootnoteRef Ref="f00002"/>, the Broadcasting and Communications (Jersey) Order 2004<FootnoteRef Ref="f00003"/>, the Communications (Bailiwick of Guernsey) Order 2003<FootnoteRef Ref="f00004"/>, the Communications (Bailiwick of Guernsey) Order 2004<FootnoteRef Ref="f00005"/> and the Communications (Isle of Man) Order 2003<FootnoteRef Ref="f00006"/>.</Text></P>

<P3para><Text>a residence is in the Bailiwick of Guernsey (but excluding Sark);</Text>

<P><Text>These Regulations amend the Communications (Television Licensing) Regulations 2004 (“the <Abbreviation Expansion="Communications (Television Licensing) Regulations 2004 (S.I. 2004/692)">2004 Regulations</Abbreviation>”)(<Citation URI="http://www.legislation.gov.uk/id/uksi/2004/692" id="c00001" Class="UnitedKingdomStatutoryInstrument" Year="2004" Number="0692">S.I. 2004/692</Citation>) and the Communications Act 2003 (“the Act”).</Text></P>
<P><Text>Regulation 5 of the 2004 Regulations is amended to reflect the change of name of the Isle of Man’s Department of Health and Social Security to the Department of Health and Social Care.</Text></P>
<P><Text>Regulation 6 of the 2004 Regulations is amended so that the television licence concession for persons aged 75 years or more will no longer be available for residents of the Isle of Man.</Text></P>
<P><Text>Regulation 6 of the 2004 Regulations is also amended so that the television licence concession for persons aged 75 years or more will no longer be available for residents of the Bailiwick of Guernsey who attain the age of 75 years on or after 1st September 2016.</Text></P>
<P><Text>The table in Schedule 3 to the 2004 Regulations, relating to fees for interim television licences, is amended as a consequence of the amendments to regulation 6.</Text></P>
<P><Text>Paragraph 10 of Schedule 4 to the 2004 Regulations is amended to update certain references to Isle of Man legislation in respect of accommodation for residential care.</Text></P>
<P><Text>Regulation 9 of the 2004 Regulations is amended to include in the definition of a television receiver any apparatus used or installed to receive an on-demand programme service which is provided by the BBC e.g. iPlayer. On-demand programme services are defined in Part 4A of the Act.</Text></P>
<P><Text>Regulation 9 of these Regulations makes a similar amendment to the definition of the use of a television receiver in section 368 of the Act to include using a television receiver to receive all or any part of a programme included in an on-demand programme service which is provided by the BBC.</Text></P>
<P><Text>An impact assessment has not been produced for this instrument as no impact on business and the voluntary sector is foreseen.</Text></P>
