The Secretary of State makes the following Regulations in exercise of the powers conferred by section 61(1) and (2)(c) of the Psychoactive Substances Act 2016(1).
1. These Regulations may be cited as the Psychoactive Substances Act 2016 (Consequential Amendments) Regulations 2016 and come into force on 26th May 2016.
2.—(1) The Visiting Forces and International Headquarters (Application of Law) Order 1999(2) is amended as follows.
(2) In Schedule 5 (enactments extending general Crown privilege to visiting forces etc.), after the entry relating to the Sunday Trading Act 1994, insert—
“The Psychoactive Substances Act 2016 (c. 2).”.
3.—(1) The Safeguarding Vulnerable Groups Act 2006 (Prescribed Criteria and Miscellaneous Provisions) Regulations 2009(3) are amended as follows.
(2) In Part 1 of the table in paragraph 2 of the Schedule (prescribed criteria – automatic inclusion in the children’s barred list with the right to make representations) insert the following entry in the appropriate place—
| “Psychoactive Substances Act 2016, section 5 | The person to whom the psychoactive substance was supplied or offered to be supplied was a child”. |
(3) In Part 1 of the table in paragraph 4 of the Schedule (prescribed criteria – automatic inclusion in the adults’ barred list with the right to make representations) insert the following entry in the appropriate place—
| “Psychoactive Substances Act 2016, section 5 | The person to whom the psychoactive substance was supplied or offered to be supplied was a child”. |

These Regulations make amendments to secondary legislation in consequence of the Psychoactive Substances Act 2016 (c. 2) (the Act).
