The Police and Crime Commissioner Elections (Returning Officers’ Accounts) (Amendment) Regulations 2016

The Chancellor of the Duchy of Lancaster makes the following Regulations in exercise of the power conferred by section 55(10) of the Police Reform and Social Responsibility Act 20111.

These Regulations may be cited as the Police and Crime Commissioner Elections (Returning Officers’ Accounts) (Amendment) Regulations 2016.

They come into force on 4th May 2016.

Amend the Police and Crime Commissioner Elections (Returning Officers’ Accounts) Regulations 20122 as follows.

(2)

In regulation 2 (interpretation), in the definition of “Accounting Officer”, for “Home Office” substitute “Cabinet Office”.

(3)

In regulation 4 (time for submission of accounts), for “8” substitute “6”.

EXPLANATORY NOTE
(This note is not part of the Regulations)

These Regulations amend the Police and Crime Commissioner Elections (Returning Officers’ Accounts) Regulations 2012 (S.I. 2012/2088) which make provision for the submission of accounts by returning officers in respect of the recovery of their charges for or in connection with a police and crime commissioner election.

In particular paragraph (2) of regulation 2 amends the definition of accounting officer to whom an account must be addressed. Now this must be the accounting officer appointed for the Cabinet Office. And paragraph (3) amends the deadline for submission of complete accounts. They must now be submitted within six months of the declaration of the result at the election to which they relate. Before it was eight.

An impact assessment has not been prepared for this instrument as no impact on the private or voluntary sector is foreseen.
