Citation, commencement and application1.
These Regulations—
(a)
may be cited as the Control of Noise (Appeals) (Amendment) (England) Regulations 2016;
(b)
come into force on 6th April 2016; and
(c)
apply to England only.

In regulation 10 (suspension of notices)—
(a)
in paragraph (1), after “a notice served under section 60” omit “, or 66”; and
(b)
in paragraph (3), after “magistrates’ court” omit “or the Secretary of State”.
These Regulations amend the Control of Noise (Appeals) Regulations 1975 to remove provisions about appeals to the Secretary of State under sections 64 to 67 of the Control of Pollution Act 1974, due to the repeal of those sections by Part 5 of Schedule 13 to the Deregulation Act 2015. The amendments apply only to England.
A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
