EXPLANATORY NOTE
Sections 26(3) and 47 of the Higher Education Act 2004() enable the Secretary of State to specify an index to which she is to have regard in deciding whether any increase in the basic or higher tuition fee amounts is no greater than required to maintain the value of the amounts in real terms.
Regulation 2 of these Regulations amends regulation 2 of Student Fees (Inflation Index) Regulations 2006(), which specifies the All Items Retail Prices Index Excluding Mortgage Interest Repayments, to clarify that this index is now published by the Office for Budget Responsibility, rather than the Office for National Statistics.
A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
