Citation and commencement1.
This Order may be cited as the NHS Foundation Trusts (Trust Funds: Appointment of Trustees) Amendment Order 2015 and comes into force on 1st April 2015.

In article 1, at paragraph (2)—
(a)
omit the definitions “company”, “executive director” and “non-executive director”;
(b)
in the definition “foundation trust”, for “Schedules” substitute “Schedule 1”.

In article 2, omit paragraph (3).

The Secretary of State may terminate a trustee’s tenure of office where the Secretary of State is of the opinion that it is not in the interests of the foundation trust or of the health service or of the administration of any of the trust funds that the trustee should continue to hold office.”.

This Order amends the NHS Foundation Trusts (Trust Funds: Appointment of Trustees) Order 2007 (S.I. 2007/1766) (the “Appointment Order”), which provides for the appointment of trustees for the NHS foundation trusts specified in the Schedules.
Article 2 of this Order amends the Appointment Order—
to remove provisions and references relating to the appointment of a company as a trustee;
to remove from the list in Schedule 1 of foundation trusts for which the Secretary of State must appoint trustees, Alder Hey Children’s NHS Foundation Trust, Birmingham Children’s Hospital NHS Foundation Trust, and Guy’s and St Thomas’s NHS Foundation Trust; and
to remove Schedule 2, which lists Royal Brompton and Harefield NHS Foundation Trust as the only foundation trust for which the Secretary of State must appoint a company as a trustee.
A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
