Coming into force in accordance with regulation 1(1)
The Lord President of the Council, in exercise of the powers conferred by section 201(3) of, and rule 19(4) of Schedule 1 to, the Representation of the People Act 1983(1), makes the following Regulations.
The Lord President has consulted the Electoral Commission as required by section 7(2)(e) of the Political Parties, Elections and Referendums Act 2000(2).
In accordance with section 201(2) of the Representation of the People Act 1983(3), a draft of this instrument has been laid before Parliament and approved by a resolution of each House of Parliament.
1983 c.2. Section 201(3) was inserted by the Representation of the People Act 2000 (c.2), section 8 and paragraphs 1 and 21 of Schedule 1, and amended by the Political Parties, Elections and Referendums Act 2000 (c.41), section 158(1) and paragraph 6(1) and (7)(d) of Schedule 21. Rule 19(4) of Schedule 1 was inserted by the Electoral Administration Act 2006 (c.22), section 30(1) and (2)(b). The powers conferred on the Secretary of State by section 201(3) and rule 19(4) were made exercisable concurrently by the Lord President of the Council and the Secretary of State by the Lord President of the Council Order 2010 (S.I. 2010/1837).
In section 201, subsection (2) was substituted by the Representation of the People Act 1985 (c.50), section 24 and paragraph 69 of Schedule 4. Subsection (2) was amended by the Transfer of Functions (Returning Officers’ Charges) Order 1991 (S.I. 1991/1728), article 5(b) and by the Political Parties, Elections and Referendums Act 2000, section 158(1) and paragraph 6(1) and (7)(b) of Schedule 21.
