The Secretary of State is a Minister designated for the purposes of section 2(2) of the European Communities Act 19721 in relation to the environment2.
The Secretary of State has consulted the Health and Safety Executive and the Office for Nuclear Regulation, as required by section 50(2) of the Health and Safety at Work etc. Act 19743 and makes these Regulations in exercise of the powers conferred by sections 15(1), (2) and (4)(a) and 43(2) of, and paragraphs 1(1)(c) and (2) and 4(1) of Schedule 3 to, that Act4 and by section 2(2) of the European Communities Act 1972.
