Enforcement20.

(1)

F1Subject to paragraph (2A), each enforcing authority must enforce these Regulations.

(2)

In relation to cases of a particular description, or a particular case—

(a)

the Secretary of State may, as regards England, direct that the duty in paragraph (1) is to be discharged by the Secretary of State and not by another enforcing authority;

(b)

the Welsh Ministers may, as regards Wales, direct that the duty in paragraph (1) is F2only to be discharged by a specific enforcing authority;

(c)

the Scottish Ministers may, as regards Scotland, direct F3SEPA or a local authority that the duty in paragraph (1) is, or is not, to be discharged by it;

(d)

F4the Department of Agriculture, Environment and Rural Affairs may, as regards Northern Ireland, direct that the duty in paragraph (1) is to be discharged by F4the Department of Agriculture, Environment and Rural Affairs and not by another enforcing authority.

F5(2A)

An enforcing authority must comply with a direction given to it under paragraph (2).

(2B)

A direction given under paragraph (2) may be revoked or modified by a further direction given under that paragraph.
