The Lord Chancellor makes these Regulations1 in exercise of the powers conferred by sections 2(3), 13(4) and (5), 15(9), 18(3) and (4), 21(2) and 41(1) to (3) of the Legal Aid, Sentencing and Punishment of Offenders Act 20122.

PART 1GENERAL

Citation, commencement and interpretation1.

(1)

These Regulations may be cited as the Criminal Legal Aid (Remuneration etc.) (Amendment) Regulations 2015.

(2)

These Regulations come into force for the purposes of—

(a)

Part 2 on 1st July 2015, and

(b)

Part 3 on 11th January 2016.

(3)

In these Regulations, “the Criminal Remuneration Regulations” means the Criminal Legal Aid (Remuneration) Regulations 20133.

Transitional provisions2.

(1)

The amendments made by Part 2 of these Regulations apply to matters in which a relevant determination is made on or after 1st July 2015.

(2)

The amendments made by Part 3 of these Regulations apply to matters in which a relevant determination is made on or after 11th January 2016.

(3)

In this regulation a “relevant determination” means a determination made under section 13 (advice and assistance for individuals in custody), section 15 (advice and assistance for criminal proceedings) or section 16 (representation for criminal proceedings) of the Legal Aid, Sentencing and Punishment of Offenders Act 2012.

PART 2AMENDMENTS COMING INTO FORCE ON 1ST JULY 2015

Amendments to the Criminal Remuneration Regulations3.

(1)

The Criminal Remuneration Regulations are amended as follows.

(2)

Schedule 2 (litigators’ graduated fee scheme) is amended as set out in Schedule 1 to these Regulations.

(3)

Schedule 3 (proceedings in the Court of Appeal) is amended as set out in Schedule 2 to these Regulations.

(4)

Schedule 4 (rates payable for the claims specified in regulation 8) is amended as set out in Schedule 3 to these Regulations.

PART 3AMENDMENTS COMING INTO FORCE ON 11TH JANUARY 2016

Amendments to the Criminal Legal Aid (General) Regulations 20134.

(1)

The Criminal Legal Aid (General) Regulations 20134 are amended as follows.

(2)

In regulation 25 (interpretation)—

(a)

in the appropriate place, insert—

““relevant contract” means whichever of the 2015 Duty Provider Crime Contract or the 2015 Own Client Crime Contract governs the provision of advice and assistance made available under sections 13 or 15 of the Act, for which remuneration is claimed;”;

(b)

in the definition of “Unit of Work”, for “1.5 of Part A of the Specification to the 2010 Standard Crime Contract” substitute “1.1 of the Standard Terms to the relevant contract”, and

(c)

for the definition of “2010 Standard Crime Contract” substitute—

““2015 Duty Provider Crime Contract” and “2015 Own Client Crime Contract” mean the contracts so named between the Lord Chancellor and a provider of advice and assistance or representation made available under sections 13, 15 or 16 of the Act.”.

(3)

In each of the following, for “2010 Standard Crime Contract” substitute “relevant contract”—

(a)

regulation 8(b) (applications);

(b)

regulation 11(3) (general);

(c)

regulation 14 (applications), in both places it occurs;

(d)

regulation 15(1)(b) (determinations);

Amendments to the Civil Legal Aid (Remuneration) Regulations 20135.

(1)

The Civil Legal Aid (Remuneration) Regulations 20136 are amended as follows.

(2)

In regulation 2(1)7 (interpretation)—

(a)

for the definition of “the relevant contract” substitute—

““the relevant contract” means whichever of the 2010 Standard Civil Contract, the 2013 Standard Civil Contract, the 2013 Individual Case Contract (Civil), the 2014 Standard Civil Contract, the 2014 Standard Civil Contract (Welfare Benefits), the 2015 Duty Provider Crime Contract, the 2015 Own Client Crime Contract or the 2015 Standard Civil Contract governs the provision of civil legal services for which remuneration is claimed; and”, and

(b)

for the entry beginning “the 2010 Standard Civil Contract” substitute—

““the 2010 Standard Civil Contract”, “the 2013 Standard Civil Contract”, “the 2013 Individual Case Contract (Civil)”, “the 2013 Individual Case Contract (High Cost Civil)”, “the 2014 Standard Civil Contract”, “the 2014 Standard Civil Contract (Welfare Benefits)”, “the 2015 Duty Provider Crime Contract”, “the 2015 Own Client Crime Contract” and “the 2015 Standard Civil Contract” mean the contracts so named between the Lord Chancellor and a provider of civil legal services under Part 1 of the Act (legal aid).”.

omit sub-paragraph (a), and

Amendments to the Criminal Remuneration Regulations6.

(1)

The Criminal Remuneration Regulations are amended as follows.

In the Table of Contents, in the entry for Schedule 2—

(a)

in the heading of Schedule 2 omit “Graduated”, and

(b)

at the appropriate place, insert “Part 1A Fixed Fees for Guilty Pleas, Cracked Trials and Trials”.

(3)

In regulation 8 (claims for fees for certain categories of work to which the Standard Crime Contract applies)—

(a)

in the heading, omit “to which the Standard Crime Contract applies”;

(b)

in paragraph (2)(a), for “2010 Standard Crime Contract” substitute “relevant contract”, and

(c)

for paragraph (3), substitute—

(ii)

for “paragraph 5(2)”, in both instances, substitute “paragraph 5”, and

(iii)

at the end of sub-paragraphs (a) and (b) insert “as appropriate to the offence with which the assisted person is charged and the number of pages of prosecution evidence served on the court”;

(c)

in paragraph (19), for ““PPE Cut-off” has” substitute ““cracked trial”, “guilty plea” and “PPE Cut-off” have”, and

(d)

Regulation 6(4)(a)

“(11)

Where the claim is made under paragraph (2)(a) the amount of the interim payment is—

(a)

in a case in which the number of pages of prosecution evidence served on the court is less than or equal to 500, 75% of the fee which, on a final determination of fees, would be paid to the litigator under paragraph 3AA of Schedule 2 if the case were a cracked trial, as appropriate to the offence with which the assisted person is charged and the number of pages of prosecution evidence served on the court;

(b)

in a case in which the number pages of prosecution evidence served on the court exceeds 500, the sum of—

(i)

the fee which, on a final determination of fees, would be paid to the litigator if paragraph 13 of Schedule 2 and the scenario “Before trial transfer (original litigator)” set out in the table following that paragraph applied, as appropriate to the offence for which the assisted person is charged and the number of pages of prosecution evidence served on the court, and

(ii)

any additional payments which, on a final determination of fees, would be paid to the litigator if paragraph 12(3)(c) of Schedule 2 applied, as appropriate to the offence with which the assisted person is charged and the number of pages of prosecution evidence served on the court.

(12)

Where the claim is made under paragraph (2)(b), the amount of the interim payment is—

(a)

in a case in which the number of pages of prosecution evidence served on the court is less than or equal to 500, 50% of the fee which, on a final determination of fees, would be paid to the litigator under paragraph 3AA of Schedule 2 if the case were a cracked trial, as appropriate to the offence with which the assisted person is charged and the number of pages of prosecution evidence served on the court;

the fee which, on a final determination of fees, would be paid to the litigator under paragraph 13 of Schedule 2 and the scenario “Transfer before cracked retrial (new litigator)” set out in the table following that paragraph, as appropriate to the offence with which the assisted person is charged and the number of pages of prosecution evidence served on the court, and

(ii)

any additional payments which, on a final determination of fees, would be paid to the litigator under paragraph 12(3)(c) of Schedule 2, as appropriate to the offence with which the assisted person is charged and the number of pages of prosecution evidence served on the court.

(13)

Where the claim is made under paragraph (2)(c), the amount of the interim payment is—

(a)

in a case in which the number of pages of prosecution evidence served on the court is less than or equal to 500, the fee which, on a final determination of fees, would be paid to the litigator under paragraph 3AA of Schedule 2 for the trial, as appropriate to the offence with which the assisted person is charged and the number of pages of prosecution evidence served on the court;

(b)

in a case in which the number pages of prosecution evidence served on the court exceeds 500, the sum of—

(i)

the fee determined in accordance with paragraph (14) on the basis that the trial length is one day, and

(ii)

any additional payments which, on a final determination of fees, would be paid to the litigator under paragraph 12(3)(b) or, where appropriate, paragraph 12(3)(d) of Schedule 2, as appropriate to the offence with which the assisted person is charged and the number of pages of prosecution evidence served on the court,

less any amount paid to the litigator, in the proceedings in question, for a claim under paragraph (2)(a) or (b).”

“PART 1AFixed Fees for Guilty Pleas, Cracked Trials and Trials

Scope3A.

(1)

Subject to sub-paragraph (2), this Part applies to all cases in which the number of pages of prosecution evidence served on the court is less than or equal to 500.

(2)

Except for a relevant cracked trial or as provided for in paragraph 21, this Part does not apply to a guilty plea or a cracked trial in a case committed or sent for trial to the Crown Court on the election of a defendant where the magistrates’ court has determined the case to be suitable for summary trial.

(3)

In sub-paragraph (2), “relevant cracked trial” means a case in which the trial is a cracked trial because the prosecution offer no evidence on all counts against a defendant and the judge directs that a not guilty verdict be entered.

Sub-paragraph (4) applies where—

(a)

proceedings to which this paragraph applies are discontinued by a notice served under section 23A of the Prosecution of Offences Act 1985 at any time after the prosecution serves its evidence in accordance with the Crime and Disorder Act 1998 (Service of Prosecution Evidence) Regulations 2005;

(b)

following a relevant application for dismissal—

(i)

the charge, or charges are dismissed and the assisted person is discharged, or

(ii)

the case is remitted to the magistrates’ court in accordance with paragraph 10(3)(a), 13(2) or 15(3)(a) of Schedule 3 to the Crime and Disorder Act 199837, or

(c)

at a relevant hearing—

(i)

the prosecution offers no evidence and the assisted person is discharged, or

(ii)

the case is remitted to the magistrates’ court in accordance with paragraph 10(3)(a), 13(2) or 15(3)(a) of Schedule 3 to the Crime and Disorder Act 1998.

(4)

Where this sub-paragraph applies, the litigator must be paid—

(a)

in a case in which the number of pages of prosecution evidence served on the court is less than or equal to 500, a fee determined in accordance with paragraph 3AA for representing an assisted person in a guilty plea, as appropriate to the offence with which the assisted person is charged and the number of pages of prosecution evidence served on the court, or

(b)

in a case in which the number pages of prosecution evidence served on the court exceeds 500, a fee calculated in accordance with paragraph 8 for representing an assisted person in a guilty plea, as appropriate to the offence with which the assisted person is charged and the number of pages of prosecution evidence served on the court.

(5)

In sub-paragraph (3)—

(a)

“relevant application for dismissal” means—

(i)

an application under paragraph 2 of Schedule 3 to the Crime and Disorder Act 199838 (procedure where persons are sent for trial under section 51: applications for dismissal);

(ii)

section 6 of the Criminal Justice Act 198739 (applications for dismissal), or

(iii)

paragraph 5 of Schedule 6 to the Criminal Justice Act 199140 (notices of transfer: procedure in lieu of committal: applications for dismissal), and

(b)

“relevant hearing” means—

(i)

a plea and case management hearing that takes place after the prosecution serves its evidence, or

(ii)

any other hearing that takes place before a plea and case management hearing has taken place, but after the prosecution has served its evidence.”

SCHEDULE 10Substitution for paragraph 23(2) of Schedule 2 to the Criminal Remuneration Regulations

Regulation 6(7)(s)

“(2)

Where in a case on indictment the warrant is not executed within three months of the date on which it was issued, the fee payable to the litigator is—

(a)

where the warrant is issued at or before the plea and case management hearing—

(i)

in a case in which the number of pages of prosecution evidence served on the court is less than or equal to 500, a fee determined in accordance with paragraph 3AA for representing an assisted person in a guilty plea, as appropriate to the offence with which the assisted person is charged and the number of pages of prosecution evidence served on the court;

in a case in which the number pages of prosecution evidence served on the court exceeds 500, a fee calculated in accordance with paragraph 8 for representing an assisted person in a guilty plea, as appropriate to the offence with which the assisted person is charged and the number of pages of prosecution evidence served on the court;

(b)

where the warrant is issued after the plea and case management hearing but before the trial—

(i)

in a case in which the number of pages of prosecution evidence served on the court is less than or equal to 500, a fee determined in accordance with paragraph 3AA for representing an assisted person in a cracked trial, as appropriate to the offence with which the assisted person is charged and the number of pages of prosecution evidence served on the court;

(ii)

in a case in which the number pages of prosecution evidence served on the court exceeds 500, a fee calculated in accordance with paragraph 8 for representing an assisted person in a cracked trial, as appropriate to the offence with which the assisted person is charged and the pages of prosecution evidence served on the court;

(c)

where the warrant is issued during the trial, and the trial is aborted as a result—

(i)

in a case in which the number of pages of prosecution evidence served on the court is less than or equal to 500, a fee determined in accordance with paragraph 3AA for representing an assisted person in a trial, as appropriate to the offence with which the assisted person is charged and the number of pages of prosecution evidence served on the court;

(ii)

in a case in which the number pages of prosecution evidence served on the court exceeds 500, a fee calculated in accordance with paragraph 7 or, where appropriate, paragraph 9 for representing an assisted person in a trial, as appropriate to the offence with which the assisted person is charged, the number of pages of prosecution evidence served on the court and the length of the trial.

(2A)

For the purpose of sub-paragraph 2(c)(ii), the length of the trial is determined as at the date the warrant is issued.”

SCHEDULE 11Substitution for paragraph 25 of Schedule 2 to the Criminal Remuneration Regulations

Regulation 6(7)(t)

“Assisted person unfit to plead or stand trial25.

(1)

Where in any case a hearing is held to determine the question of whether the assisted person is unfit to plead or to stand trial (a “fitness hearing”)—

(a)

if a trial on indictment is held, or continues, at any time thereafter, the length of the fitness hearing is (where relevant) included in determining the length of the trial for the calculation of the fee;

(b)

if a trial on indictment is not held, or does not continue, by reason of the assisted person being found unfit to plead or to stand trial, the litigator must be paid—

(i)

in a case in which the number of pages of prosecution evidence served on the court is less than or equal to 500 whichever of the following fees the litigator elects—

(aa)

a fee determined in accordance with paragraph 3AA for representing an assisted person in a trial, as appropriate to the Class of Offence elected by the litigator under paragraph 3(1)(f) and the number of pages of prosecution evidence served on the court, or

(bb)

a fee determined in accordance with paragraph 3AA for representing an assisted person in a cracked trial, as appropriate to the Class of Offence elected by the litigator under paragraph 3(1)(f) and the number of pages of prosecution evidence served on the court;

(ii)

in a case in which the number of pages of prosecution evidence served on the court exceeds 500 whichever of the following fees the litigator elects—

(aa)

a fee calculated in accordance with paragraph 7 or, where appropriate, paragraph 9 for representing an assisted person in a trial, as appropriate to the combined length of the relevant hearings, the Class of Offence elected by the litigator under paragraph 3(1)(f) and the number of pages of prosecution evidence served on the court, or

(bb)

a fee calculated in accordance with paragraph 8 for representing an assisted person in a cracked trial, as appropriate to the Class of Offence elected by the litigator under paragraph 3(1)(f) and the number of pages of prosecution evidence served on the court,

and

(c)

if at any time the assisted person pleads guilty to the indictable offence, the litigator must be paid—

(i)

in a case in which the number of pages of prosecution evidence served on the court is less than or equal to 500 whichever of the following fees the litigator elects—

(aa)

a fee determined in accordance with paragraph 3AA for representing an assisted person in a trial, as appropriate to the Class of Offence elected by the litigator under paragraph 3(1)(f) and the number of pages of prosecution evidence served on the court, or

(bb)

a fee determined in accordance with paragraph 3AA for representing an assisted person in a guilty plea, as appropriate to the Class of Offence elected by the litigator under paragraph 3(1)(f) and the number of pages of prosecution evidence served on the court;

(ii)

in a case in which the number of pages of prosecution evidence served on the court exceeds 500 whichever of the following fees the litigator elects—

(aa)

a fee calculated in accordance with paragraph 7 or, where appropriate, paragraph 9 for representing an assisted person in a trial, as appropriate to the length of the fitness hearing, the Class of Offence elected by the litigator under paragraph 3(1)(f) and the number of pages of prosecution evidence served on the court, or

(bb)

a fee calculated in accordance with paragraph 8 for representing an assisted person in a guilty plea, as appropriate to the Class of Offence elected by the litigator under paragraph 3(1)(f) and the number of pages of prosecution evidence served on the court.

(2)

In sub-paragraph (1)(b)(ii)(aa), “relevant hearings” means—

(a)

the fitness hearing, and

(b)

any hearing under section 4A of the Criminal Procedure (Insanity) Act 196441 (finding that the accused did the act or made the omission charged against him).”

EXPLANATORY NOTE
(This note is not part of the Regulations)

This instrument amends the Criminal Legal Aid (Remuneration) Regulations 2013 (S.I. 2013/435) (“the Criminal Remuneration Regulations”), which make provision for the remuneration of criminal legal aid (advice and assistance or representation made available under section 13, 15 or 16 of the Legal Aid Sentencing and Punishment of Offenders Act 2012 (c. 10) (“the Act”)).

Part 2 of and Schedules 1 to 3 to this instrument reduce the fees payable for representation in the Crown Court to which Schedule 2 to the Criminal Remuneration Regulations applies (litigators’ graduated fee scheme), representation in the Court of Appeal to which Schedule 3 to the Criminal Remuneration Regulations applies (proceedings in the Court of Appeal) and certain categories of work to which Schedule 4 to the Criminal Remuneration Regulations applies (advice and assistance, representation in the magistrates’ court, representation for proceedings relating to an injunction under Part 1 of the Anti-social Behaviour, Crime and Policing Act 2014 (c. 12) or prescribed as criminal under section 14(h) of the Act, representation in certain other appeals and payment for Assigned Counsel). The fees introduced represent a 17.5% reduction from the rates applicable in April 2013.

Part 3 of and Schedules 4 to 13 to this instrument introduce new fee schemes for representation in the Crown Court under Schedule 2 to the Criminal Remuneration Regulations and certain advice and assistance and magistrates’ court representation under Schedule 4 of those regulations. Regulation 6(7)(c) of and Schedule 5 to this instrument inserts a new Part 1A in Schedule 2 to the Criminal Remuneration Regulations, introducing fixed fees for guilty pleas, cracked trials and trials for cases in which the number of pages of prosecution evidence is less than or equal to 500. Regulation 6(8) of and Schedules 12 and 13 to this instrument amend Schedule 4 to the Criminal Remuneration Regulations to introduce a new fixed fee structure for Police Station advice and assistance and standard fee structure for representation in magistrates’ courts.

This instrument also makes amendments to the Criminal Remuneration Regulations, the Criminal Legal Aid (General) Regulations (S.I. 2013/9), Civil Legal Aid (Remuneration) Regulations 2013 (S.I. 2013/422) and the Criminal Legal Aid (Financial Resources) Regulations (S.I. 2013/471) consequential on the 2015 Duty Provider Crime Contract and Own Client Crime Contract which replace the 2010 Standard Crime Contract (regulations 4, 5, 6(3) and (8)(b) and 7). The remaining provisions make consequential amendments or minor clarifications.

The amendments made by Part 2 of this instrument apply to matters in which a determination under section 13, 15 or 16 of the Act is made on or after 1st July 2015. The amendments made by Part 3 apply to matters in which a determination under section 13, 15 or 16 is made on or after 11th January 2016.
