The Wreck Removal Convention Act 2011 (Commencement) Order 2015

The Secretary of State, in exercise of the powers conferred by section 2 of the Wreck Removal Convention Act 20111, makes the following Order.

Citation and commencement1.

(1)

This Order may be cited as the Wreck Removal Convention Act 2011 (Commencement) Order 2015.

(2)

In this Order “the Act” means the Wreck Removal Convention Act 2011.

Provisions coming into force on 5th February 20152.

(1)

Section 1 of the Act comes into force on 5th February 2015 insofar as it inserts sections 255A (“the Wrecks Convention”), 255J (Wreck removal insurance), 255N (issue of certificates) and 255R (interpretation etc.) and Schedule 11ZA into the Merchant Shipping Act 19952 for the purposes set out in paragraph (2).

(2)

The purposes are to enable the Secretary of State—

(a)

to issue wreck removal insurance certificates in accordance with section 255N,

(b)

to make regulations under section 302 of the Merchant Shipping Act 1995 prescribing the fees to be charged in respect of the issue of such certificates, and

(c)

by order to describe the United Kingdom’s Convention area.

Provisions coming into force on 14th April 20153.

The Act comes into force on 14th April 2015, so far as it is not already in force on that date.

EXPLANATORY NOTE
(This note is not part of the Order)

This Order brings into force the provisions of the Wreck Removal Convention Act 2011.

On 5th February 2015 new sections 255A, 255J, 255N and 255R of, and Schedule 11 ZA to, the Merchant Shipping Act 1995 are brought into force to the extent necessary to enable the Secretary of State—

(a)

to issue wreck removal insurance certificates to shipowners,

(b)

to make regulations prescribing the fees for such certificates, and

(c)

to describe the United Kingdom’s Convention area,

in preparation for the date when the Nairobi International Convention on the Removal of Wrecks 2007 comes into force.

On 14th April 2015, the date when the Convention comes into force, the provisions referred to above come into force for all other purposes and the remainder of the Act comes into force.
