sections 15(1) and 146 of, and paragraphs 308 and 332 of Schedule 4 and Part 2 of Schedule 18 to, the Constitutional Reform Act <ref eId="c00003" href="http://www.legislation.gov.uk/id/ukpga/2005/4">2005 (c. 4)</ref>.</p></authorialNote>, after consulting in accordance with section 72(1)(a) of that Act.</p></formula></preamble><body><hcontainer name="crossheading" ukl:Name="P1group"><heading>Citation, commencement and interpretation</heading><rule eId="article-1"><num>1.</num><content><p>These Rules may be cited as the Criminal Procedure (Amendment) Rules 2015.</p></content></rule><rule eId="article-2"><num>2.</num><content><p>Rules 5, 7, 8, 10, 14 and 15 of these Rules shall come into force on 2nd February 2015 and rules 4, 6, 9, 11, 12, 13 and 16 on 6th April 2015.</p></content></rule><rule eId="article-3"><num>3.</num><content><p>In these Rules, a reference to a Part or rule by number alone means the Part or rule so numbered in the Criminal Procedure Rules 2014<authorialNote class="footnote" eId="f00002" marker="2"><p><ref eId="c00004" href="http://www.legislation.gov.uk/id/uksi/2014/1610">S.I. 2014/1610</ref>.</p></authorialNote>.</p></content></rule></hcontainer><hcontainer name="crossheading" ukl:Name="P1group"><heading>Amendments to the Criminal Procedure Rules 2014</heading><rule eId="article-4"><num>4.</num><intro><p>In Part 3 (Case management)—</p></intro><level class="para1" eId="article-4-a"><num>(a)</num><content><p><mod>in rule 3.9 (Case preparation and progression) after paragraph (6) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><paragraph><num>(7)</num><intro><p>Where directions for appropriate treatment and questioning are required, the court must―</p></intro><level class="para1"><num>(a)</num><content><p>invite representations by the parties and by any intermediary; and</p></content></level><level class="para1"><num>(b)</num><intro><p>set ground rules for the conduct of the questioning, which rules may include―</p></intro><level class="para2"><num>(i)</num><content><p>a direction relieving a party of any duty to put that party’s case to a witness or a defendant in its entirety,</p></content></level><level class="para2"><num>(ii)</num><content><p>directions about the manner of questioning,</p></content></level><level class="para2"><num>(iii)</num><content><p>directions about the duration of questioning,</p></content></level><level class="para2"><num>(iv)</num><content><p>if necessary, directions about the questions that may or may not be asked,</p></content></level><level class="para2"><num>(v)</num><content><p>where there is more than one defendant, the allocation among them of the topics about which a witness may be asked, and</p></content></level><level class="para2"><num>(vi)</num><content><p>directions about the use of models, plans, body maps or similar aids to help communicate a question or an answer.</p></content></level></level></paragraph></quotedStructure><inline name="appendText">; and</inline></mod></p></content></level><level class="para1" eId="article-4-b"><num>(b)</num><intro><p>in rule 3.13 (Pre-trial hearings: general rules)—</p></intro><level class="para2" eId="article-4-b-i"><num>(i)</num><content><p>at the end of paragraph (1)(c)(i), omit ‘or’,</p></content></level><level class="para2" eId="article-4-b-ii"><num>(ii)</num><content><p>at the end of paragraph (1)(c)(ii), insert ‘, or’, and</p></content></level><level (Investigation orders and warrants)—</p></intro><level class="para1" eId="article-5-a"><num>(a)</num><intro><p>in rule 6.1 (When this Part applies)—</p></intro><level class="para2" eId="article-5-a-i"><num>(i)</num><content><p><mod>for paragraph (2) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><paragraph><num>(2)</num><intro><p>Sections 2 and 4 of this Part apply where, for the purposes of an investigation to which Part 8 of the Proceeds of Crime Act 2002 or the Proceeds of Crime Act 2002 (External Investigations) Order 2014<authorialNote class="footnote" eId="f00003" marker="3"><p><ref eId="c00005" href="http://www.legislation.gov.uk/id/uksi/2014/1893">S.I. 2014/1893</ref>.</p></authorialNote> applies, a Crown Court judge can make, and the Crown Court can vary or discharge—</p></intro><level class="para1"><num>(a)</num><content><p>a production order, under sections 345 and 351 of the 2002 Act<authorialNote class="footnote" eId="f00004" marker="4"><p><ref eId="c00006" href="http://www.legislation.gov.uk/id/ukpga/2002/29">2002 c. 29</ref>; section 345 was amended by section 75 of the Serious Crime Act <ref eId="c00007" href="http://www.legislation.gov.uk/id/ukpga/2007/27">2007 (c. 27)</ref>. Under paragraph 41 of that Schedule and regulation 41 of the 2013 Regulations, on an application for authority to sell goods otherwise than by public auction the enforcement agent must give notice to a creditor of the defendant in the circumstances described in those provisions.]</i></p></wrapUp></article><article><heading>Warrant of control: application to resolve dispute</heading><num>52.9.</num><paragraph><num>(1)</num><intro><p>This rule applies where a defendant’s goods are sold using the procedure in Schedule 12 to the Tribunals, Courts and Enforcement Act 2007 and there is a dispute about—</p></intro><level class="para1"><num>(a)</num><content><p>what share of the proceeds of those goods should be paid by the enforcement agent to a co-owner; or</p></content></level><level class="para1"><num>(b)</num><content><p>the fees or disbursements sought or recovered by the enforcement agent out of the proceeds.</p></content></level></paragraph><paragraph><num>(2)</num><intro><p>An enforcement agent, a defendant or a co-owner who wants the court to resolve the dispute must—</p></intro><level class="para1"><num>(a)</num><content><p>apply in writing as soon as practicable after becoming aware of the grounds for doing so;</p></content></level><level class="para1"><num>(b)</num><intro><p>serve the application on—</p></intro><level class="para2"><num>(i)</num><content><p>the court officer,</p></content></level><level class="para2"><num>(ii)</num><content><p>each other party to the dispute, and</p></content></level><level class="para2"><num>(iii)</num><content><p>any other co-owner; and</p></content></level></level><level class="para1"><num>(c)</num><content><p>pay any fee prescribed.</p></content></level></paragraph><paragraph><num>(3)</num><intro><p>The application must—</p></intro><level class="para1"><num>(a)</num><content><p>identify the warrant of control;</p></content></level><level class="para1"><num>(b)</num><content><p>specify the goods sold, the proceeds, and the fees and disbursements sought or recovered by the enforcement agent;</p></content></level><level class="para1"><num>(c)</num><content><p>identify the power that the applicant wants the court to exercise;</p></content></level><level class="para1"><num>(d)</num><content><p>specify the persons served with the application;</p></content></level><level class="para1"><num>(e)</num><content><p>explain the circumstances of the dispute; and</p></content></level><level class="para1"><num>(f)</num><content><p>propose the terms of the order that the applicant wants the court to make.</p></content></level></paragraph><paragraph><num>(4)</num><intro><p>A person served with an application who wants to make representations to the court must—</p></intro><level class="para1"><num>(a)</num><intro><p>serve the representations on—</p></intro><level class="para2"><num>(i)</num><content><p>the court officer,</p></content></level><level class="para2"><num>(ii)</num><content><p>the applicant, and</p></content></level><level class="para2"><num>(iii)</num><content><p>any other person on whom the application was served;</p></content></level></level><level class="para1"><num>(b)</num><content><p>do so as soon as reasonably practicable and in any event within such period as the court directs; and</p></content></level><level class="para1"><num>(c)</num><content><p>in the representations, propose the terms of the order that that person wants the court to make, and explain why.</p></content></level></paragraph><paragraph><num>(5)</num><intro><p>The court—</p></intro><level class="para1"><num>(a)</num><content><p>must determine an application at a hearing, which must be in private unless the court otherwise directs;</p></content></level><level class="para1"><num>(b)</num><intro><p>must not determine an application unless each party—</p></intro><level class="para2"><num>(i)</num><content><p>is present, or</p></content></level><level class="para2"><num>(ii)</num><content><p>has had a reasonable opportunity to attend.</p></content></level></level></paragraph><wrapUp><p><i>[Note. and</p></content></level><level class="para1"><num>(b)</num><content><p>the prosecutor asks the court to make such an order, or the court decides to make such an order on its own initiative.</p></content></level></paragraph><paragraph><num>(2)</num><intro><p>Within such periods as the court directs—</p></intro><level class="para1"><num>(a)</num><content><p>if the court so orders, the defendant must give such information, in such manner, as the court directs;</p></content></level><level class="para1"><num>(b)</num><content><p>the prosecutor must serve a statement of information relevant to confiscation on the court officer and the defendant;</p></content></level><level class="para1"><num>(c)</num><intro><p>if the court so directs—</p></intro><level class="para2"><num>(i)</num><content><p>the defendant must serve a response notice on the court officer and the prosecutor, and</p></content></level><level class="para2"><num>(ii)</num><content><p>the parties must identify what is in dispute.</p></content></level></level></paragraph><paragraph><num>(3)</num><intro><p>The court may—</p></intro><level class="para1"><num>(a)</num><content><p>shorten or extend a time limit which it has set;</p></content></level><level class="para1"><num>(b)</num><content><p>vary, discharge or supplement an order which it has made.</p></content></level></paragraph><paragraph><num>(4)</num><intro><p>A prosecutor’s statement of information must—</p></intro><level class="para1"><num>(a)</num><content><p>identify the maker of the statement and show its date;</p></content></level><level class="para1"><num>(b)</num><content><p>identify the defendant in respect of whom it is served;</p></content></level><level class="para1"><num>(c)</num><content><p>specify the conviction which gives the court power to make the confiscation order, or each conviction if more than one;</p></content></level><level class="para1"><num>(d)</num><intro><p>if the prosecutor believes the defendant to have a criminal lifestyle, include such matters as the prosecutor believes to be relevant in connection with deciding—</p></intro><level class="para2"><num>(i)</num><content><p>whether the defendant has such a lifestyle,</p></content></level><level class="para2"><num>(ii)</num><content><p>whether the defendant has benefited from his or her general criminal conduct,</p></content></level><level class="para2"><num>(iii)</num><content><p>the defendant’s benefit from that conduct, and</p></content></level><level class="para2"><num>(iv)</num><content><p>whether the court should or should not make such assumptions about the defendant’s property as legislation permits;</p></content></level></level><level class="para1"><num>(e)</num><intro><p>if the prosecutor does not believe the defendant to have a criminal lifestyle, include such matters as the prosecutor believes to be relevant in connection with deciding—</p></intro><level class="para2"><num>(i)</num><content><p>whether the defendant has benefited from his or her particular criminal conduct, and</p></content></level><level class="para2"><num>(ii)</num><content><p>the defendant’s benefit from that conduct.</p></content></level></level></paragraph><paragraph><num>(5)</num><intro><p>A defendant’s response notice must—</p></intro><level class="para1"><num>(a)</num><content><p>indicate the extent to which the defendant accepts the allegations made in the prosecutor’s statement of information; and</p></content></level><level class="para1"><num>(b)</num><content><p>so far as the defendant does not accept an allegation, give particulars of any matters on which the defendant relies,</p></content></level><wrapUp><p>in any manner directed by the court.</p></wrapUp></paragraph><paragraph><num>(6)</num><intro><p>The court must satisfy itself that there has been explained to the defendant, in terms the defendant can understand (with help, if necessary)—</p></intro><level class="para1"><num>(a)</num><content><p>that if the defendant accepts to any extent an allegation in a prosecutor’s statement of information, then the court may treat that as conclusive for the purposes of deciding whether the defendant has benefited from general or particular criminal conduct, and if so by how much;</p></content></level><level class="para1"><num>(b)</num><content><p>that if the defendant fails in any respect to comply with a direction to serve a response notice, then the court may treat that as acceptance of each allegation to which the defendant has not replied, except the allegation that the defendant has benefited from general or particular criminal conduct;
