These Regulations amend the Customs (Inspections by Her Majesty’s Inspectors of Constabulary and the Scottish Inspectors) Regulations 2012(1).
Regulation 4 amends regulation 6 of the 2012 Regulations, which provides for the delegation of their functions by Her Majesty’s Inspectors of Constabulary, to remove the ability to delegate to a public body other than Her Majesty’s Inspectorate of Prisons.
Regulation 5 amends Part 1 of the Schedule to the 2012 Regulations to provide for changes in the locations of customs detention premises in England and Wales since the 2012 Regulations. Her Majesty’s Inspectors of Constabulary have the power to inspect and report on the efficiency and effectiveness of the exercise of specified functions by customs officials or contractors, where that conduct takes place at one or more of the customs detention premises listed in the Schedule, or in a vehicle used to transport a person to or from those premises, in England and Wales.
