The Road Safety (Financial Penalty Deposit) (Appropriate Amount) (Amendment) Order 2014

The Secretary of State for Transport makes the following Order in exercise of the powers conferred by sections 90B(2) and 90E(3) of the Road Traffic Offenders Act 19881.

The Secretary of State has consulted such representative organisations as appear appropriate in accordance with section 90E(2) of that Act.

A draft of this instrument has been laid before, and approved by a resolution of, each House of Parliament in accordance with section 90E(4) of that Act.

Citation and commencement1.

This Order may be cited as the Road Safety (Financial Penalty Deposit) (Appropriate Amount) (Amendment) Order 2014 and comes into force on 1^st April 2014.

Amendment of the Road Safety (Financial Penalty Deposit) (Appropriate Amount) Order 20092.

The Road Safety (Financial Penalty Deposit) (Appropriate Amount) Order 20092 is amended as follows.

In Part 1 of Schedule 1, after Table 8 (Goods Vehicles (Licensing of Operators) Act 1995), add—

Using or keeping a heavy goods vehicle on a road in the UK without paying the HGV road user levy

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Road Safety (Financial Penalty Deposit) (Appropriate Amount) Order 2009 by adding to the Schedule showing the monetary amount of a financial penalty deposit that a constable or vehicle examiner may require from the person in charge of a heavy goods vehicle suspected of committing an offence under section 11 of the HGV Road User Levy Act 2013.

A full impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen. An Explanatory Memorandum has been prepared and is available alongside this instrument on the website, www.legislation.gov.uk.
