Coming into force in accordance with Article 1(2)

The Secretary of State, in exercise of the powers conferred by regulation 16(1) and (5) of the European Parliamentary Elections (Northern Ireland) Regulations 2004(1), makes the following Order with the consent of the Treasury(2).

Citation and commencement

1.—(1) This Order may be cited as the European Parliamentary Elections (Returning Officer’s Charges) (Northern Ireland) Order 2014.

(2) This Order comes into force on the day after the day on which it is made.

Overall maximum recoverable amount

2.  For the purposes of regulation 16(1) of the European Parliamentary Elections (Northern Ireland) Regulations 2004, the amount specified as the overall maximum recoverable amount is—

(a)at a contested European Parliamentary election, £2,018,146; and

(b)at an uncontested European Parliamentary election, within the meaning of rule 17 of Schedule 1 to the 2004 Regulations (the European Parliamentary elections rules), £1,750.

Revocation

3.  The European Parliamentary Elections (Returning Officer’s Charges) (Northern Ireland) Order 2009(3) is revoked.

EXPLANATORY NOTE

(This note is not part of the Order)

Under regulation 16 of the European Parliamentary Elections (Northern Ireland) Regulations 2004 the Secretary of State may specify by order the maximum amount that the returning officer for the electoral region of Northern Ireland may recover in respect of charges incurred, in accordance with the provisions of that regulation, at a European Parliamentary election.

This Order specifies the maximum amounts that may be recovered at both contested and uncontested European Parliamentary elections. At a contested election the maximum amount is £2,018,146 and at an uncontested election it is £1,750.

An impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
