The CMA Registers of Undertakings and Orders (Available Hours) Order 2014

The Secretary of State, in exercise of the powers conferred by sections 91(6) and 166(6) of the Enterprise Act 20021 hereby makes the following Order:

Citation, commencement and interpretation1.

(1)

This Order may be cited as the CMA Registers of Undertakings and Orders (Available Hours) Order 2014 and comes into force on 1st April 2014.

(2)

In this Order—

“the register” means a register maintained by the CMA under section 91 or 166 of the Enterprise Act 2002; and

“working day” means any day which is not Saturday, Sunday, Good Friday, Christmas Day, a bank holiday or public holiday in England and Wales or any other day on which the office of the CMA at which the register is available to the public is closed for business.

Available Hours2.

The CMA shall ensure that the contents of the register are available to the public (as a minimum) between the hours of 10.00 am and 4.00 pm on any working day.

Revocation3.

The OFT Registers of Undertakings and Orders (Available Hours) Order 20032 is revoked.

EXPLANATORY NOTE
(This note is not part of the Order)

This Order specifies the minimum hours during which the Competition and Markets Authority must ensure that the contents of the registers of undertakings and orders that it maintains for the purposes of Part 3 (mergers) and Part 4 (market investigations) of the Enterprise Act 2002 are available to the public. The hours specified are from 10.00 am to 4.00 pm on any working day.

Article 3 revokes the OFT Registers of Undertakings and Orders (Available Hours) Order 2003 (S.I. 2003/1373).

No impact assessment has been produced in relation to this Order as no impact on business or the private or voluntary sectors is foreseen.
