Her Majesty, in exercise of the powers conferred by section 147(3) of the Merchant Shipping Act 1995(1), is pleased, by and with the advice of Her Privy Council, to order as follows:

Citation and commencement

1.  This Order may be cited as the Prevention of Oil Pollution (Convention Countries) (Revocation) Order 2014 and comes into force on 7th April 2014.

Revocation

2.  The Prevention of Oil Pollution (Convention Countries) Order 1981(2) is revoked.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order revokes the Prevention of Oil Pollution (Convention Countries) Order 1981 (S.I. 1981/612) (“the 1981 Order”).

The 1981 Order consolidated earlier Orders (as listed in Schedule 2 to the 1981 Order) which declared those countries which had accepted the International Convention for the Prevention of Pollution of the Sea by Oil 1954 and listed the territories to which it extended. The requirements of this Convention were incorporated into the International Convention for the Prevention of Pollution from Ships (MARPOL), which was adopted in 1973. This was absorbed by the 1978 MARPOL Protocol, and the combined instrument entered into force in 1983. The 1981 Order is therefore no longer relevant and can be revoked.

A full regulatory impact assessment has not been produced for this instrument as no impact on the business, public or voluntary sectors is foreseen. The Explanatory Memorandum is published alongside the instrument at www.legislation.gov.uk.

S.I. 1981/612. Following the repeal of section 21(3) of the Prevention of Oil Pollution Act 1971 (c. 60) and the re-enactment of the powers (with modifications) in section 147(3) of the Merchant Shipping Act 1995, this Order has effect as if made under those re-enacted provisions.
