The Secretary of State, being a Minister designated1 for the purposes of section 2(2) of the European Communities Act 19722 in relation to measures relating to copyright and rights in performances, in exercise of powers conferred by that section and section 78 of the Enterprise and Regulatory Reform Act 20133 makes the following Regulations:

Citation and commencement1

These Regulations may be cited as the Copyright and Duration of Rights in Performances (Amendment) Regulations 2014 and come into force on 6th April 2014.

Amendment to the Copyright, Designs and Patents Act 19882

In section 191HA(1) of the Copyright, Designs and Patents Act 19884, after “a performer has” insert “by an agreement”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the provisions of section 191HA of the Copyright, Designs and Patents Act to render it clear that the references to “the agreement” in section 191HA(2), (3) and (4) are to an agreement pursuant to which a performer has assigned certain rights as described in section 191HA(1).

An impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
