SCHEDULE 4ITMA as an approved regulator: regulatory arrangements

In this Schedule—

  • “registered person” means—

    1. a

      an individual who is both registered and authorised by ITMA acting in its capacity as an approved regulator; or

    2. b

      an ITMA-registered body;

  • “regulated person” means a person who is not a registered person but is a manager or employee of a body which is a registered person;

  • “trade mark attorney regulations” means regulations which apply to registered persons and which are made by ITMA acting in its capacity as an approved regulator under either—

    1. a

      section 83A of the 1994 Act; or

    2. b

      this Order.

In relation to an ITMA-registered body, references in this Schedule to a regulated person include the Head of Legal Practice and the Head of Finance and Administration of that body.

Regulations under this Schedule may—

a

make provision generally or subject to exceptions or only in relation to specified cases;

b

make different provision for different cases or circumstances or for different purposes.
