The Secretary of State makes the following Order in exercise of the power conferred on him by section 241(6) of the Enterprise Act 2002(1).

Citation and commencement

1.  This Order may be cited as the Enterprise Act 2002 (Part 9 Restrictions on Disclosure of Information) (Amendment) Order 2014 and comes into force on 17th November 2014.

Amendment of the Enterprise Act 2002

2.  In Schedule 15(2) to the Enterprise Act 2002 at the end insert—

Financial Services (Banking Reform) Act 2013.

EXPLANATORY NOTE

(This note is not part of the Order)

Part 9 of the Enterprise Act 2002 (“the Act”) restricts the disclosure of specified information which relates to the affairs of an individual or any business of an undertaking. Specified information is defined by section 238 of the Act. Section 241 of the Act provides that a public authority may disclose specified information which is restricted by Part 9 of the Act to another person, for the purposes of facilitating the exercise of functions the person has under an enactment specified in Schedule 15. This Order adds the Financial Services (Banking Reform) Act 2013 (c. 33) to Schedule 15.

An impact assessment has not been prepared for this Order as it has no impact on the costs of business, charities or voluntary bodies. The Explanatory Memorandum is published alongside the Order on www.legislation.gov.uk.
