The Motor Vehicles (Tests) (Amendment) Regulations 2014

Coming into force

The Secretary of State for Transport makes the following Regulations in exercise of the powers conferred by sections 45(7) and 46(1)(f) and (7) of the Road Traffic Act 19881.

Representative organisations have been consulted in accordance with section 195(2) of that Act.

In determining the amount of the fees specified in these Regulations, the Secretary of State has taken into account the costs of the functions listed in paragraphs 21, 22 and 24 of Schedule 1 to the Department for Transport (Fees) Order 20092 and has taken into account the matters listed in Schedule 2 to that Order in determining the costs of those functions.

Citation and commencement1

These Regulations may be cited as the Motor Vehicles (Tests) (Amendment) Regulations 2014 and come into force on 1st October 2014.

Amendment of Regulations2

The Motor Vehicles (Tests) Regulations 19813 are amended as follows.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Motor Vehicles (Tests) Regulations 1981 (“the 1981 Regulations”), which make provision for certain motor vehicles to be examined by persons authorised by the Secretary of State and for test certificates to be issued for vehicles that are found to meet certain requirements. These certificates are commonly referred to as “MOT Certificates”.

Regulation 3 makes amendments to regulation 20 of the 1981 Regulations. Regulation 20 prescribes the fees payable for examinations of vehicles pursuant to applications made under regulation 12 of those Regulations. In relation to Class VI and Class VIA vehicles, fees for tests conducted at designated premises (premises not provided by the Driver and Vehicle Services Agency (DVSA)) are further reduced, whilst fees for tests at premises provided by DVSA are increased. Class VI and VIA vehicles are public service vehicles of the types specified in regulation 5 of the 1981 Regulations.

New fees for examinations of vehicles in Classes VI and VIA are set out in the following table (with percentage increases or decreases, since the fees were last fixed with effect from 1st April 2012, shown in brackets) and take effect on 1st October 2014.
