<Text>The objections to that application have been withdrawn.</Text></P>
<P>
<Text>The Secretary of State has determined to make an Order giving effect to the proposals comprised in the application with modifications which in the Secretary of State’s opinion do not make any substantial change in the proposals.</Text></P>

<Para><Text>“authorised works” means Works <Abbreviation Expansion="Numbers">Nos.</Abbreviation> 2 to 6 (or any part of them) authorised by the 2008 Order or any other works adjacent to or in the Parish of Westerfield in the Borough of Ipswich within the Order limits, or any other works in Suffolk Coastal District within the Order limits authorised by the 2008 Order;</Text>

<Para><Text>“the book of reference” means the book of reference certified by the Secretary of State as the book of reference for the purposes of this Order;</Text>

<Para><Text>“the land plans” means the plans certified by the Secretary of State as the land plans for the purpose of this Order;</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“limits of deviation” means the limits of deviation for the authorised works shown on the land plans;</Text>

<ListItem>
<Para><Text>“the limits of land to be acquired or used” means the limits of land to be acquired or used shown on the land plans;</Text>

<Para><Text>“the Order limits” means any limits of deviation and any limits of land to be acquired or used which are shown on the land plans;</Text>

<Title>Temporary use of land for maintenance of works</Title>

<P2para><Text>Subject to paragraph (2), at any time during the maintenance period relating to any of the authorised works, the undertaker may—</Text>

<Pnumber>1</Pnumber>
<P2para><Text>In assessing the compensation payable to any person in respect of the acquisition from that person under this Order of any land (including the subsoil) the tribunal must set off against the value of the land so acquired any increase in value of any contiguous or adjacent land belonging to that person in the same capacity which will accrue to that person by reason of the construction of the authorised works.</Text>

<Pnumber>2</Pnumber>

<Text>In assessing the compensation payable to any person in respect of the acquisition from that person of any new rights over land (including the subsoil) under article 6 (power to acquire new rights), the tribunal must set off against the value of the rights so acquired—</Text>

<P2para><Text>This article applies instead of section 8(1) (other provisions as to divided land) of the 1965 Act<FootnoteRef Ref="f00012"/> (as applied by article 4 (application of Part 1 of the 1965 Act)) in any case where—</Text>

<Pnumber>a</Pnumber>

<Text>a notice to treat is served on a person (“the owner”) under the 1965 Act (as applied) in respect of land forming only part of a house, building or manufactory or of land consisting of a house with a park or garden (“the land subject to the notice to treat”); and</Text>
</P3para></P3>

<Pnumber>b</Pnumber>

<Text>a copy of this article is served on the owner with the notice to treat.</Text>

<Text>In such a case, the owner may, within the period of 21 days beginning with the day on which the notice was served, serve on the undertaker a counter-notice objecting to the sale of the land subject to the notice to treat which states that the owner is willing and able to sell the whole (“the land subject to the counter-notice”).</Text>

<Text>If no such counter-notice is served within that period, the owner is required to sell the land subject to the notice to treat.</Text>

<Text>If such a counter-notice is served within that period, the question whether the owner is required to sell only the land subject to the notice to treat is, unless the undertaker agrees to take the land subject to the counter-notice, to be referred to the tribunal.</Text>

<Text>the material detriment is confined to a part of the land subject to the counter-notice,</Text>

<Text>the notice to treat is deemed to be a notice to treat for the land to which the material detriment is confined in addition to the land already subject to the notice, whether or not the additional land is land which the undertaker is authorised to acquire compulsorily under this Order.</Text>
</P2para>
</P2>

<Pnumber>8</Pnumber>
<P2para>
<Text>If the undertaker agrees to take the land subject to the counter-notice, or if the tribunal determine that—</Text>
<P3 DocumentURI="http://www.legislation.gov.uk/uksi/2014/1821/article/12/8/a" IdURI="http://www.legislation.gov.uk/id/uksi/2014/1821/article/12/8/a" id="article-12-8-a">
<Pnumber>a</Pnumber>
<P3para>
<Text>none of the land subject to the notice to treat can be taken without material detriment to the remainder of the land subject to the counter-notice or, as the case may be, without material detriment to the remainder of the land subject to the counter-notice and without seriously affecting the amenity and convenience of the house; and</Text>
</P3para></P3>
<P3 DocumentURI="http://www.legislation.gov.uk/uksi/2014/1821/article/12/8/b" IdURI="http://www.legislation.gov.uk/id/uksi/2014/1821/article/12/8/b" id="article-12-8-b">
<Pnumber>b</Pnumber>
<P3para>
<Text>the material detriment is not confined to a part of the land subject to the counter-notice,</Text>
</P3para></P3>
<Text>the notice to treat is deemed to be a notice to treat for the land subject to the counter-notice whether or not the whole of that land is land which the undertaker is authorised to acquire compulsorily under this Order.</Text>

</P2>

<Pnumber>9</Pnumber>
<P2para>
<Text>In any case where by virtue of a determination by the tribunal under this article a notice to treat is deemed to be a notice to treat for less land or more land than that specified in the notice, the undertaker may, within the period of 6 weeks beginning with the day on which the determination is made, withdraw the notice to treat; and if the undertaker does so the undertaker must pay the owner compensation for any loss or expense occasioned to the owner by the giving and withdrawal of the notice, to be determined in case of dispute by the tribunal.</Text>

</P2>

<Text>Where the owner is required under this article to sell only part of a house, building or manufactory or of land consisting of a house with a park or garden, the undertaker must pay the owner compensation for any loss sustained by the owner due to the severance of that part in addition to the value of the interest acquired.</Text>

<Title>Extinction or suspension of private rights of way</Title>

<P2para><Text>All private rights of way over land subject to compulsory acquisition under this Order are extinguished—</Text>

<Text>on the date of entry on the land by the undertaker under section 11(1) (powers of entry) of the 1965 Act<FootnoteRef Ref="f00013"/>,</Text>

</P2>
<Text>whichever is the sooner.</Text>

<Pnumber>2</Pnumber>
<P2para>
<Text>In respect of land owned by the undertaker and required for the purposes of this Order all private rights of way are extinguished on the appropriation of the land for any of those purposes by the undertaker.</Text>
</P2para>
</P2>
<P2 DocumentURI="http://www.legislation.gov.uk/uksi/2014/1821/article/13/3" IdURI="http://www.legislation.gov.uk/id/uksi/2014/1821/article/13/3" id="article-13-3">
<Pnumber>3</Pnumber>
<P2para>
<Text>All private rights of way over land of which the undertaker takes temporary possession under this Order are suspended and unenforceable for as long as the undertaker remains in lawful possession of the land.</Text>
</P2para>
</P2>

<Pnumber>4</Pnumber>

<Text>Any person who suffers loss by the extinguishment or suspension of any private right of way under this article is entitled to compensation to be determined, in case of dispute, under Part 1 of the 1961 Act.</Text>

<Title>EXPLANATORY NOTE</Title>

</Comment>
<P><Text>This Order confers powers on The Felixstowe Dock and Railway Company for the compulsory acquisition of land and interests in land in the Borough of Ipswich and Suffolk Coastal District, Suffolk. The powers are conferred for the purposes of constructing and operating an additional railway line adjacent to part of the existing Felixstowe branch railway line and improvements to certain level crossings on the existing Felixstowe branch railway line. Such works were authorised by the Felixstowe Branch Line and Ipswich Yard Improvement Order 2008 (<Citation URI="http://www.legislation.gov.uk/id/uksi/2008/2512" id="c00001" Class="UnitedKingdomStatutoryInstrument" Year="2008" Number="2512">S.I. 2008/2512</Citation>) (“the 2008 Order”). The compulsory acquisition powers conferred by the 2008 Order expired on 14<Superior>th</Superior> October 2013.</Text></P>
<P><Text>This Order does not authorise the construction of works.</Text></P>
