section 1 was amended by the Planning Act <ref eId="c00011" href="http://www.legislation.gov.uk/id/ukpga/2008/29">2008 (c. 29)</ref>, Schedule 2, paragraphs 51 and 52; section 5 was amended by <ref eId="c00012" href="http://www.legislation.gov.uk/id/uksi/2012/1659">S.I. 2012/1659</ref>.</p></authorialNote> (“the <abbr title="Transport and Works Act 1992 c. 42">1992 Act</abbr>”).</p><p>The objections to that application have been withdrawn.</p><p>The Secretary of State has determined to make an Order giving effect to the proposals comprised in the application with modifications which in the Secretary of State’s opinion do not make any substantial change in the proposals.</p><p>Notice of the Secretary of State’s determination was published in the London Gazette on 7th July 2014.</p><formula name="enactingText"><p>The Secretary of State, in exercise of the powers conferred by sections 1 and 5 of, and paragraphs 3 to 5, 7, 8, 11, and 16 of Schedule<span ukl:Name="NonBreakingSpace"> </span>1 to, the <abbr title="Transport and Works Act 1992 c. 42">1992 Act</abbr>, makes the following Order—</p></formula></preamble><body eId="body"><part eId="part-1"><num>PART 1</num><heading>PRELIMINARY</heading><article eId="article-1"><heading>Citation and commencement</heading><num>1.</num><content><p>This Order may be cited as the Felixstowe Branch Line (Land Acquisition) Order 2014 and comes into force on 29th July 2014.</p></content></article><article eId="article-2"><heading>Interpretation</heading><num>2.</num><paragraph eId="article-2-1"><num>(1)</num><intro><p>In this Order—</p></intro><hcontainer name="definition"><content><p>“the <abbr title="Land Compensation Act 1961 c. 33">1961 Act</abbr>” means the Land Compensation Act 1961<authorialNote class="footnote" eId="f00003" marker="3"><p><ref eId="c00013" href="http://www.legislation.gov.uk/id/ukpga/1961/33">1961 c. 33</ref>.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“the <abbr title="Compulsory Purchase Act 1965 c. 56">1965 Act</abbr>” means the Compulsory Purchase Act 1965<authorialNote class="footnote" eId="f00004" marker="4"><p><ref eId="c00014" href="http://www.legislation.gov.uk/id/ukpga/1965/56">1965 c. 56</ref>.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“the <abbr title="Felixstowe Branch Line and Ipswich Yard Improvement Order 2008 (S.I. 2008/2512)">2008 Order</abbr>” means the Felixstowe Branch Line and Ipswich Yard Improvement Order 2008<authorialNote class="footnote" eId="f00005" marker="5"><p><ref eId="c00015" href="http://www.legislation.gov.uk/id/uksi/2008/2512">S.I. 2008/2512</ref>.</p></authorialNote>;</p></content></hcontainer><hcontainer name="definition"><content><p>“authorised works” means Works <abbr title="Numbers">Nos.</abbr> 2 to 6 (or any part of them) authorised by the <abbr title="Felixstowe Branch Line and Ipswich Yard Improvement Order 2008 (S.I. 2008/2512)">2008 Order</abbr> or any other works adjacent to or in the Parish of Westerfield in the Borough of Ipswich within the Order limits, or any other works in Suffolk Coastal District within the Order limits authorised by the <abbr title="Felixstowe Branch Line and Ipswich Yard Improvement Order 2008 (S.I. 2008/2512)">2008 Order</abbr>;</p></content></hcontainer><hcontainer name="definition"><content><p>“the book of reference” means the book of reference certified by the Secretary of State as the book of reference for the purposes of this Order;</p></content></hcontainer><hcontainer name="definition"><content><p>“the land plans” means the plans certified by the Secretary of State as the land plans for the purpose of this Order;</p></content></hcontainer><hcontainer name="definition"><content><p>“limits of deviation” means the limits of deviation for the authorised works shown on the land plans;</p></content></hcontainer><hcontainer name="definition"><content><p>“the limits of land to be acquired or used” means the limits of land to be acquired or used shown on the land plans;</p></content></hcontainer><hcontainer name="definition"><content><p>“the Order limits” means any limits of deviation and any limits of land to be acquired or used which are shown on the land plans;</p></content></hcontainer><hcontainer name="definition"><content><p>“<abbr title="the Lands Chamber of the Upper Tribunal">tribunal</abbr>” means the Lands Chamber of the Upper Tribunal; and</p></content></hcontainer><hcontainer name="definition"><content><p>“<abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr>” means The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875<authorialNote class="footnote" eId="f00006" marker="6"><p><ref eId="c00016" href="http://www.legislation.gov.uk/id/ukla/1875/145">1875 c. cxlv</ref>.</p></authorialNote>.</p></content></hcontainer></paragraph><paragraph eId="article-2-2"><num>(2)</num><content><p>References in this Order to rights over land include references to rights to do, or to place and maintain, anything in, on or under land or in the air-space over its surface.</p></content></paragraph><paragraph eId="article-2-3"><num>(3)</num><content><p>References in this Order to numbered works are references to the works as numbered in Schedule 1 (scheduled works) to the <abbr title="Felixstowe Branch Line and Ipswich Yard Improvement Order 2008 (S.I. 2008/2512)">2008 Order</abbr>.</p></content></paragraph><paragraph eId="article-2-4"><num>(4)</num><content><p>All measurements stated in any description of lands in the book of reference are approximate.</p></content></paragraph></article></part><part eId="part-2"><num>PART 2</num><heading>ACQUISITION AND POSSESSION OF LAND</heading><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-2-crossheading-powers-of-acquisition"><heading>Powers of acquisition</heading><article eId="article-3"><heading>Power to acquire land</heading><num>3.</num><paragraph eId="article-3-1"><num>(1)</num><content><p>The undertaker may acquire compulsorily so much of the land shown on the land plans within the Order limits and described in the book of reference as may be required for the purposes of the authorised works and may use any land so acquired for those purposes or for any other purposes that are ancillary to its railway undertaking.</p></content></paragraph><paragraph eId="article-3-2"><num>(2)</num><content><p>This article is subject to article 8 (temporary use of land for construction of works).</p></content></paragraph></article><article eId="article-4"><heading>Application of Part 1 of the <abbr title="Compulsory Purchase Act 1965 c. 56">1965 Act</abbr></heading><num>4.</num><paragraph eId="article-4-1"><num>(1)</num><intro><p>Part 1 of the <abbr title="Compulsory Purchase Act 1965 c. 56">1965 Act</abbr>, in so far as not modified by or inconsistent with the provisions of this Order, applies to the acquisition of land under this Order—</p></intro><level class="para1" eId="article-4-1-a"><num>(a)</num><content><p>as it applies to a compulsory purchase to which the Acquisition of Land Act 1981<authorialNote class="footnote" eId="f00007" marker="7"><p><ref eId="c00017" href="http://www.legislation.gov.uk/id/ukpga/1981/67">1981 c. 67</ref>.</p></authorialNote> applies; and</p></content></level><level class="para1" eId="article-4-1-b"><num>(b)</num><content><p>as if this Order were a compulsory purchase order under that Act.</p></content></level></paragraph><paragraph eId="article-4-2"><num>(2)</num><content><p>Part 1 of the <abbr title="Compulsory Purchase Act 1965 c. 56">1965 Act</abbr>, as applied by paragraph (1), has effect as if section 4 (which provides a time limit for compulsory purchase of land) and paragraph 3(3) of Schedule 3 (which makes provision as to the giving of bonds) were omitted.</p></content></paragraph></article><article eId="article-5"><heading>Application of the Compulsory Purchase (Vesting Declarations) Act 1981</heading><num>5.</num><paragraph eId="article-5-1"><num>(1)</num><content><p>The Compulsory Purchase (Vesting Declarations) Act 1981<authorialNote class="footnote" eId="f00008" marker="8"><p><ref eId="c00018" href="http://www.legislation.gov.uk/id/ukpga/1981/66">1981 c. 66</ref>.</p></authorialNote> applies as if this Order were a compulsory purchase order.</p></content></paragraph><paragraph eId="article-5-2"><num>(2)</num><content><p>The Compulsory Purchase (Vesting Declarations) Act 1981, as applied by paragraph (1), has effect with the following modifications.</p></content></paragraph><paragraph eId="article-5-3"><num>(3)</num><content><p><mod>In section 3 (preliminary notices) for subsection (1) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><paragraph><num>(1)</num><intro><p>Before making a declaration under section 4 with respect to any land which is subject to a compulsory purchase order the acquiring authority must include the particulars specified in subsection (3) in a notice which is—</p></intro><level class="para1"><num>(a)</num><content><p>given to every person with a relevant interest in the land with respect to which the declaration is to be made (other than a mortgagee who is not in possession); and</p></content></level><level class="para1"><num>(b)</num><content><p>published in a local newspaper circulating in the area in which the land is <span ukl:Name="EmSpace"> </span>situated.</p></content></level></paragraph></quotedStructure><inline name="appendText">.</inline></mod></p></content></paragraph><paragraph eId="article-5-4"><num>(4)</num><content><p>In that section, in subsection (2), for “(l)(b)” substitute “(1)”, and after “given” insert “and published”.</p></content></paragraph><paragraph eId="article-5-5"><num>(5)</num><content><p><mod>In that section, for subsections (5) and (6) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><paragraph><num>(5)</num><intro><p>For the purposes of this section, a person has a relevant interest in land if—</p></intro><level class="para1"><num>(a)</num><content><p>that person is for the time being entitled to dispose of the fee simple of the land, whether in possession or in reversion; or</p></content></level><level class="para1"><num>(b)</num><content><p>that person holds, or is entitled to the rents and profits of, the land under a lease or agreement, the unexpired term of which exceeds one month.</p></content></level></paragraph></quotedStructure><inline name="appendText">.</inline></mod></p></content></paragraph><paragraph eId="article-5-6"><num>(6)</num><intro><p>In section 5 (earliest date for execution of declaration)—</p></intro><level class="para1" eId="article-5-6-a"><num>(a)</num><content><p>in subsection (1), after “publication” insert “in a local newspaper circulating in the area in which the land is situated”; and</p></content></level><level class="para1" eId="article-5-6-b"><num>(b)</num><content><p>omit subsection (2).</p></content></level></paragraph><paragraph eId="article-5-7"><num>(7)</num><content><p>In section 7 (constructive notice to treat) in subsection (l)(a), omit “(as modified by section 4 of the Acquisition of Land Act 1981)”.</p></content></paragraph><paragraph eId="article-5-8"><num>(8)</num><content><p>References to the <abbr title="Compulsory Purchase Act 1965 c. 56">1965 Act</abbr> are to be construed as references to that Act as applied to the acquisition of land under article 3 (power to acquire land).</p></content></paragraph></article><article eId="article-6"><heading>Power to acquire new rights</heading><num>6.</num><paragraph eId="article-6-1"><num>(1)</num><content><p>The undertaker may acquire compulsorily such easements or other rights over any land referred to in paragraph (1) of article 3 (power to acquire land) as may be required for any purpose for which that land may be acquired under that provision, by creating them as well as by acquiring easements or other rights already in existence.</p></content></paragraph><paragraph eId="article-6-2"><num>(2)</num><content><p>Subject to section 8 of the <abbr title="Compulsory Purchase Act 1965 c. 56">1965 Act</abbr> (as substituted by paragraph 5 of Schedule 6 (modification of compensation and compulsory purchase enactments for creation of new rights) to the <abbr title="Felixstowe Branch Line and Ipswich Yard Improvement Order 2008 (S.I. 2008/2512)">2008 Order</abbr>, as applied by article 15 (application of provisions of the <abbr title="Felixstowe Branch Line and Ipswich Yard Improvement Order 2008 (S.I. 2008/2512)">2008 Order</abbr>)) where <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> acquires a right over land under paragraph (1) <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> is not required to acquire a greater interest in that land.</p></content></paragraph><paragraph eId="article-6-3"><num>(3)</num><content><p>Schedule 6 to the <abbr title="Felixstowe Branch Line and Ipswich Yard Improvement Order 2008 (S.I. 2008/2512)">2008 Order</abbr>, as applied by article 15, has effect for the purpose of modifying the enactments relating to compensation and the provisions of the <abbr title="Compulsory Purchase Act 1965 c. 56">1965 Act</abbr> in their application in relation to the compulsory acquisition under this article of a right over land by the creation of a new right.</p></content></paragraph></article><article eId="article-7"><heading>Rights under or over streets</heading><num>7.</num><paragraph eId="article-7-1"><num>(1)</num><content><p>The undertaker may enter upon and appropriate so much of the subsoil of, or air-space over, any street within the Order limits as may be required for the purposes of the authorised works and may use the subsoil or air-space for those purposes or any other purpose ancillary to its railway undertaking.</p></content></paragraph><paragraph eId="article-7-2"><num>(2)</num><content><p>Subject to paragraph (4), the power under paragraph (1) may be exercised in relation to a street without <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> being required to acquire any part of the street or any easement or right in the street.</p></content></paragraph><paragraph eId="article-7-3"><num>(3)</num><content><p>Subject to paragraph (5), any person who is an owner or occupier of land in respect of which the power of appropriation conferred by paragraph (1) is exercised without <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> acquiring any part of that person’s interest in the land, and who suffers loss by the exercise of that power, is entitled to compensation to be determined, in case of dispute, under Part 1 of the <abbr title="Land Compensation Act 1961 c. 33">1961 Act</abbr>.</p></content></paragraph><paragraph eId="article-7-4"><num>(4)</num><intro><p>Paragraph (2) does not apply in relation to—</p></intro><level class="para1" eId="article-7-4-a"><num>(a)</num><content><p>any subway or underground building; or</p></content></level><level class="para1" eId="article-7-4-b"><num>(b)</num><content><p>any cellar, vault, arch or other construction in, on or under a street which forms part of a building fronting onto the street.</p></content></level></paragraph><paragraph eId="article-7-5"><num>(5)</num><content><p>Compensation is not payable under paragraph (3) to any person who is an undertaker to whom section 85 (sharing of cost of necessary measures) of the New Roads and Street Works Act 1991<authorialNote class="footnote" eId="f00009" marker="9"><p><ref eId="c00019" href="http://www.legislation.gov.uk/id/ukpga/1991/22">1991 c. 22</ref>.</p></authorialNote> applies in respect of measures of which the allowable costs are to be borne in accordance with that section.</p></content></paragraph></article></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-2-crossheading-temporary-possession-of-land"><heading>Temporary possession of land</heading><article eId="article-8"><heading>Temporary use of land for construction of works</heading><num>8.</num><paragraph eId="article-8-1"><num>(1)</num><intro><p>The undertaker may, in connection with the carrying out of the authorised works—</p></intro><level class="para1" eId="article-8-1-a"><num>(a)</num><content><p>enter upon and take temporary possession of the land specified in columns (1) and (2) of the Schedule (land of which temporary possession may be taken) for the purpose specified in relation to that land in column (3) of the Schedule relating to the authorised works specified in column (4) of the Schedule;</p></content></level><level class="para1" eId="article-8-1-b"><num>(b)</num><content><p>remove any buildings and vegetation from that land;</p></content></level><level class="para1" eId="article-8-1-c"><num>(c)</num><content><p>construct temporary works (including the provision of means of access) and buildings on that land; and</p></content></level><level class="para1" eId="article-8-1-d"><num>(d)</num><content><p>use the land for the purposes of a working site with access to the working site in connection with the authorised works.</p></content></level></paragraph><paragraph eId="article-8-2"><num>(2)</num><content><p>Not less than 14 days before entering upon and taking temporary possession of land under this article <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> must serve notice of the intended entry on the owners and occupiers of the land.</p></content></paragraph><paragraph eId="article-8-3"><num>(3)</num><content><p>The undertaker may not, without the agreement of the owners of the land, remain in possession of any land under this article after the end of the period of one year beginning with the date of completion of the work specified in relation to that land in column (4) of the Schedule.</p></content></paragraph><paragraph eId="article-8-4"><num>(4)</num><content><p>Before giving up possession of land of which temporary possession has been taken under this article, <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> must remove all temporary works and restore the land to the reasonable satisfaction of the owners of the land; but <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> is not required to replace a building removed under this article.</p></content></paragraph><paragraph eId="article-8-5"><num>(5)</num><content><p>The undertaker must pay compensation to the owners and occupiers of land of which temporary possession is taken under this article for any loss or damage arising from the exercise in relation to the land of the powers conferred by this article.</p></content></paragraph><paragraph eId="article-8-6"><num>(6)</num><content><p>Any dispute as to a person’s entitlement to compensation under paragraph (5), or as to the amount of the compensation, is to be determined under Part 1 of the <abbr title="Land Compensation Act 1961 c. 33">1961 Act</abbr>.</p></content></paragraph><paragraph eId="article-8-7"><num>(7)</num><content><p>Without affecting article 51 (no double recovery) of the <abbr title="Felixstowe Branch Line and Ipswich Yard Improvement Order 2008 (S.I. 2008/2512)">2008 Order</abbr> as applied by article 15 (application of provisions of the <abbr title="Felixstowe Branch Line and Ipswich Yard Improvement Order 2008 (S.I. 2008/2512)">2008 Order</abbr>), nothing in this article affects any liability to pay compensation under section 10(2) (further provision as to compensation for injurious affection) of the <abbr title="Compulsory Purchase Act 1965 c. 56">1965 Act</abbr><authorialNote class="footnote" eId="f00010" marker="10"><p>Section 10 was amended by section 4 of, and paragraph 13(2) of Schedule 2 to, the Planning (Consequential Provisions) Act <ref eId="c00020" href="http://www.legislation.gov.uk/id/ukpga/1990/11">1990 (c. 11)</ref> and <ref eId="c00021" href="http://www.legislation.gov.uk/id/uksi/2009/1307">S.I. 2009/1307</ref>.</p></authorialNote> or under any other enactment in respect of loss or damage arising from the execution of any works, other than loss or damage for which compensation is payable under paragraph (5).</p></content></paragraph><paragraph eId="article-8-8"><num>(8)</num><content><p>The powers of compulsory acquisition of land conferred by this Order do not apply in relation to the land referred to in paragraph (1) except that <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> is not precluded from acquiring new rights over any part of that land under article 6 (power to acquire new rights).</p></content></paragraph><paragraph eId="article-8-9"><num>(9)</num><content><p>Where <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> takes possession of land under this article, <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> is not required to acquire the land or any interest in it.</p></content></paragraph><paragraph eId="article-8-10"><num>(10)</num><content><p>Section 13 (refusal to give possession to acquiring authority) of the <abbr title="Compulsory Purchase Act 1965 c. 56">1965 Act</abbr><authorialNote class="footnote" eId="f00011" marker="11"><p>Section 13 was amended by sections 62(3) and 139 of, and paragraph 27 and 28 of Schedule 13, and part 3 of Schedule 23, to, the Tribunals, Courts and Enforcement Act <ref eId="c00022" href="http://www.legislation.gov.uk/id/ukpga/2007/15">2007 (c. 15)</ref>.</p></authorialNote> applies to the temporary use of land under this article to the same extent as it applies to the acquisition of land under this Order by virtue of article 4(1) (application of Part 1 of the <abbr title="Compulsory Purchase Act 1965 c. 56">1965 Act</abbr>).</p></content></paragraph></article><article eId="article-9"><heading>Temporary use of land for maintenance of works</heading><num>9.</num><paragraph eId="article-9-1"><num>(1)</num><intro><p>Subject to paragraph (2), at any time during the maintenance period relating to any of the authorised works, <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> may—</p></intro><level class="para1" eId="article-9-1-a"><num>(a)</num><content><p>enter upon and take temporary possession of any land within the Order limits if such possession is reasonably required for the purpose of maintaining the work or any ancillary works connected with it; and</p></content></level><level class="para1" eId="article-9-1-b"><num>(b)</num><content><p>construct such temporary works (including the provision of means of access) and buildings on the land as may be reasonably necessary for that purpose.</p></content></level></paragraph><paragraph eId="article-9-2"><num>(2)</num><intro><p>Paragraph (1) does not authorise <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> to take temporary possession of—</p></intro><level class="para1" eId="article-9-2-a"><num>(a)</num><content><p>any house or garden belonging to a house; or</p></content></level><level class="para1" eId="article-9-2-b"><num>(b)</num><content><p>any building (other than a house) if it is for the time being occupied.</p></content></level></paragraph><paragraph eId="article-9-3"><num>(3)</num><content><p>Not less than 28 days before entering upon and taking temporary possession of land under this article <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> must serve notice of the intended entry on the owners and occupiers of the land.</p></content></paragraph><paragraph eId="article-9-4"><num>(4)</num><content><p>The undertaker may only remain in possession of land under this article for so long as may be reasonably necessary to carry out the maintenance of works for which possession of the land was taken.</p></content></paragraph><paragraph eId="article-9-5"><num>(5)</num><content><p>Before giving up possession of land of which temporary possession has been taken under this article, <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> must remove all temporary works and restore the land to the reasonable satisfaction of the owners of the land.</p></content></paragraph><paragraph eId="article-9-6"><num>(6)</num><content><p>The undertaker must pay compensation to the owners and occupiers of land of which temporary possession is taken under this article for any loss or damage arising from the exercise in relation to the land of the powers conferred by this article.</p></content></paragraph><paragraph eId="article-9-7"><num>(7)</num><content><p>Any dispute as to a person’s entitlement to compensation under paragraph (6), or as to the amount of the compensation, is to be determined under Part 1 of the <abbr title="Land Compensation Act 1961 c. 33">1961 Act</abbr>.</p></content></paragraph><paragraph eId="article-9-8"><num>(8)</num><content><p>Without affecting article 51 (no double recovery) of the <abbr title="Felixstowe Branch Line and Ipswich Yard Improvement Order 2008 (S.I. 2008/2512)">2008 Order</abbr> as applied by article 15 (application of provisions of the <abbr title="Felixstowe Branch Line and Ipswich Yard Improvement Order 2008 (S.I. 2008/2512)">2008 Order</abbr>), nothing in this article affects any liability to pay compensation under section 10(2) of the <abbr title="Compulsory Purchase Act 1965 c. 56">1965 Act</abbr> or under any other enactment in respect of loss or damage arising from the execution of any works, other than loss or damage for which compensation is payable under paragraph (6).</p></content></paragraph><paragraph eId="article-9-9"><num>(9)</num><content><p>Where <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> takes possession of land under this article, <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> is not required to acquire the land or any interest in it.</p></content></paragraph><paragraph eId="article-9-10"><num>(10)</num><content><p>Section 13 of the <abbr title="Compulsory Purchase Act 1965 c. 56">1965 Act</abbr> applies to the temporary use of land pursuant to this article to the same extent as it applies to the acquisition of land under this Order by virtue of article 4(1) (application of Part 1 of the <abbr title="Compulsory Purchase Act 1965 c. 56">1965 Act</abbr>).</p></content></paragraph><paragraph eId="article-9-11"><num>(11)</num><content><p>In this article “the maintenance period”, in relation to an authorised work, means the period of 5 years beginning with the date on which the work is opened for use.</p></content></paragraph></article></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-2-crossheading-compensation"><heading>Compensation</heading><article eId="article-10"><heading>Disregard of certain interests and improvements</heading><num>10.</num><hcontainer name="wrapper2"><paragraph eId="article-10-1"><num>(1)</num><intro><p>In assessing the compensation payable to any person on the acquisition from that person of any land under this Order, the <abbr title="the Lands Chamber of the Upper Tribunal">tribunal</abbr> must not take into account—</p></intro><level class="para1" eId="article-10-1-a"><num>(a)</num><content><p>any interest in land; or</p></content></level><level class="para1" eId="article-10-1-b"><num>(b)</num><content><p>any enhancement of the value of any interest in land by reason of any building erected, works executed or improvement or alteration made on relevant land,</p></content></level></paragraph></hcontainer><hcontainer name="wrapper2"><intro><p>if the <abbr title="the Lands Chamber of the Upper Tribunal">tribunal</abbr> is satisfied that the creation of the interest, the erection of the building, the execution of the works or the making of the improvement or alteration was not reasonably necessary and was undertaken with a view to obtaining compensation or increased compensation.</p></intro><paragraph eId="article-10-2"><num>(2)</num><content><p>In paragraph (1) “relevant land” means the land acquired from the person concerned or any other land with which that person is, or was at the time when the building was erected, the works executed or the improvement or alteration made, directly or indirectly concerned.</p></content></paragraph></hcontainer></article><article eId="article-11"><heading>Set-off for enhancement in value of retained land</heading><num>11.</num><paragraph eId="article-11-1"><num>(1)</num><content><p>In assessing the compensation payable to any person in respect of the acquisition from that person under this Order of any land (including the subsoil) the <abbr title="the Lands Chamber of the Upper Tribunal">tribunal</abbr> must set off against the value of the land so acquired any increase in value of any contiguous or adjacent land belonging to that person in the same capacity which will accrue to that person by reason of the construction of the authorised works.</p></content></paragraph><paragraph eId="article-11-2"><num>(2)</num><intro><p>In assessing the compensation payable to any person in respect of the acquisition from that person of any new rights over land (including the subsoil) under article 6 (power to acquire new rights), the <abbr title="the Lands Chamber of the Upper Tribunal">tribunal</abbr> must set off against the value of the rights so acquired—</p></intro><level class="para1" eId="article-11-2-a"><num>(a)</num><content><p>any increase in the value of the land over which the new rights are required; and</p></content></level><level class="para1" eId="article-11-2-b"><num>(b)</num><content><p>any increase in value of any contiguous or adjacent land belonging to that person in the same capacity,</p></content></level><wrapUp><p>which will accrue to that person by reason of the construction of the authorised works.</p></wrapUp></paragraph><paragraph eId="article-11-3"><num>(3)</num><content><p>The <abbr title="Land Compensation Act 1961 c. 33">1961 Act</abbr> has effect, subject to paragraphs (1) and (2), as if this Order were a local enactment for the purposes of that Act.</p></content></paragraph></article></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock" eId="part-2-crossheading-supplementary"><heading>Supplementary</heading><article eId="article-12"><heading>Acquisition of part of certain properties</heading><num>12.</num><paragraph eId="article-12-1"><num>(1)</num><intro><p>This article applies instead of section 8(1) (other provisions as to divided land) of the <abbr title="Compulsory Purchase Act 1965 c. 56">1965 Act</abbr><authorialNote class="footnote" eId="f00012" marker="12"><p>Section 8 was amended by <ref eId="c00023" href="http://www.legislation.gov.uk/id/uksi/2009/1307">S.I. 2009/1307</ref>.</p></authorialNote> (as applied by article 4 (application of Part 1 of the <abbr title="Compulsory Purchase Act 1965 c. 56">1965 Act</abbr>)) in any case where—</p></intro><level class="para1" eId="article-12-1-a"><num>(a)</num><content><p>a notice to treat is served on a person (“the owner”) under the <abbr title="Compulsory Purchase Act 1965 c. 56">1965 Act</abbr> (as applied) in respect of land forming only part of a house, building or manufactory or of land consisting of a house with a park or garden (“the land subject to the notice to treat”); and</p></content></level><level class="para1" eId="article-12-1-b"><num>(b)</num><content><p>a copy of this article is served on the owner with the notice to treat.</p></content></level></paragraph><paragraph eId="article-12-2"><num>(2)</num><content><p>In such a case, the owner may, within the period of 21 days beginning with the day on which the notice was served, serve on <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> a counter-notice objecting to the sale of the land subject to the notice to treat which states that the owner is willing and able to sell the whole (“the land subject to the counter-notice”).</p></content></paragraph><paragraph eId="article-12-3"><num>(3)</num><content><p>If no such counter-notice is served within that period, the owner is required to sell the land subject to the notice to treat.</p></content></paragraph><paragraph eId="article-12-4"><num>(4)</num><content><p>If such a counter-notice is served within that period, the question whether the owner is required to sell only the land subject to the notice to treat is, unless <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> agrees to take the land subject to the counter-notice, to be referred to the <abbr title="the Lands Chamber of the Upper Tribunal">tribunal</abbr>.</p></content></paragraph><paragraph eId="article-12-5"><num>(5)</num><intro><p>If on such a reference the <abbr title="the Lands Chamber of the Upper Tribunal">tribunal</abbr> determine that the land subject to the notice to treat can be taken—</p></intro><level class="para1" eId="article-12-5-a"><num>(a)</num><content><p>without material detriment to the remainder of the land subject to the counter-notice; or</p></content></level><level class="para1" eId="article-12-5-b"><num>(b)</num><content><p>in the case of part of land consisting of a house with a park or garden, without material detriment to the remainder of the land subject to the counter-notice and without seriously affecting the amenity and convenience of the house,</p></content></level><wrapUp><p>the owner is required to sell the land subject to the notice to treat.</p></wrapUp></paragraph><paragraph eId="article-12-6"><num>(6)</num><intro><p>If on such a reference the <abbr title="the Lands Chamber of the Upper Tribunal">tribunal</abbr> determine that only part of the land subject to the notice to treat can be taken—</p></intro><level class="para1" eId="article-12-6-a"><num>(a)</num><content><p>without material detriment to the remainder of the land subject to the counter-notice; or</p></content></level><level class="para1" eId="article-12-6-b"><num>(b)</num><content><p>in the case of part of land consisting of a house with a park or garden, without material detriment to the remainder of the land subject to the counter-notice and without seriously affecting the amenity and convenience of the house,</p></content></level><wrapUp><p>the notice to treat is deemed to be a notice to treat for that part.</p></wrapUp></paragraph><paragraph eId="article-12-7"><num>(7)</num><intro><p>If on such a reference the <abbr title="the Lands Chamber of the Upper Tribunal">tribunal</abbr> determine that—</p></intro><level class="para1" eId="article-12-7-a"><num>(a)</num><content><p>the land subject to the notice to treat cannot be taken without material detriment to the remainder of the land subject to the counter-notice; but</p></content></level><level class="para1" eId="article-12-7-b"><num>(b)</num><content><p>the material detriment is confined to a part of the land subject to the counter-notice,</p></content></level><wrapUp><p>the notice to treat is deemed to be a notice to treat for the land to which the material detriment is confined in addition to the land already subject to the notice, whether or not the additional land is land which <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> is authorised to acquire compulsorily under this Order.</p></wrapUp></paragraph><paragraph eId="article-12-8"><num>(8)</num><intro><p>If <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> agrees to take the land subject to the counter-notice, or if the <abbr title="the Lands Chamber of the Upper Tribunal">tribunal</abbr> determine that—</p></intro><level class="para1" eId="article-12-8-a"><num>(a)</num><content><p>none of the land subject to the notice to treat can be taken without material detriment to the remainder of the land subject to the counter-notice or, as the case may be, without material detriment to the remainder of the land subject to the counter-notice and without seriously affecting the amenity and convenience of the house; and</p></content></level><level class="para1" eId="article-12-8-b"><num>(b)</num><content><p>the material detriment is not confined to a part of the land subject to the counter-notice,</p></content></level><wrapUp><p>the notice to treat is deemed to be a notice to treat for the land subject to the counter-notice whether or not the whole of that land is land which <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> is authorised to acquire compulsorily under this Order.</p></wrapUp></paragraph><paragraph eId="article-12-9"><num>(9)</num><content><p>In any case where by virtue of a determination by the <abbr title="the Lands Chamber of the Upper Tribunal">tribunal</abbr> under this article a notice to treat is deemed to be a notice to treat for less land or more land than that specified in the notice, <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> may, within the period of 6 weeks beginning with the day on which the determination is made, withdraw the notice to treat; and if <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> does so <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> must pay the owner compensation for any loss or expense occasioned to the owner by the giving and withdrawal of the notice, to be determined in case of dispute by the <abbr title="the Lands Chamber of the Upper Tribunal">tribunal</abbr>.</p></content></paragraph><paragraph eId="article-12-10"><num>(10)</num><content><p>Where the owner is required under this article to sell only part of a house, building or manufactory or of land consisting of a house with a park or garden, <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> must pay the owner compensation for any loss sustained by the owner due to the severance of that part in addition to the value of the interest acquired.</p></content></paragraph></article><article eId="article-13"><heading>Extinction or suspension of private rights of way</heading><num>13.</num><hcontainer name="wrapper2"><paragraph eId="article-13-1"><num>(1)</num><intro><p>All private rights of way over land subject to compulsory acquisition under this Order are extinguished—</p></intro><level class="para1" eId="article-13-1-a"><num>(a)</num><content><p>as from the date of acquisition of the land by <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr>, whether compulsorily or by agreement; or</p></content></level><level class="para1" eId="article-13-1-b"><num>(b)</num><content><p>on the date of entry on the land by <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> under section 11(1) (powers of entry) of the <abbr title="Compulsory Purchase Act 1965 c. 56">1965 Act</abbr><authorialNote class="footnote" eId="f00013" marker="13"><p>Section 11 was amended by section 34(1) of, and Schedule 4 to, the Acquisition of Land Act <ref eId="c00024" href="http://www.legislation.gov.uk/id/ukpga/1981/67">1981 (c. 67)</ref>, section 3 of, and part 1 of Schedule 1 to, the Housing (Consequential Provisions) Act <ref eId="c00025" href="http://www.legislation.gov.uk/id/ukpga/1985/71">1985 (c. 71)</ref>, section 14 of, and paragraph 12(1) of Schedule 5 to, the Church of England (Miscellaneous Provisions) Measure 2006 (<ref eId="c00026" href="http://www.legislation.gov.uk/id/ukcm/2006/1">2006 No 1</ref>) and <ref eId="c00027" href="http://www.legislation.gov.uk/id/uksi/2009/1307">S.I. 2009/1307</ref>.</p></authorialNote>,</p></content></level></paragraph></hcontainer><hcontainer name="wrapper2"><intro><p>whichever is the sooner.</p></intro><paragraph eId="article-13-2"><num>(2)</num><content><p>In respect of land owned by <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> and required for the purposes of this Order all private rights of way are extinguished on the appropriation of the land for any of those purposes by <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr>.</p></content></paragraph><paragraph eId="article-13-3"><num>(3)</num><content><p>All private rights of way over land of which <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> takes temporary possession under this Order are suspended and unenforceable for as long as <abbr title="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</abbr> remains in lawful possession of the land.</p></content></paragraph><paragraph eId="article-13-4"><num>(4)</num><content><p>Any person who suffers loss by the extinguishment or suspension of any private right of way under this article is entitled to compensation to be determined, in case of dispute, under Part 1 of the <abbr title="Land Compensation Act 1961 c. 33">1961 Act</abbr>.</p></content></paragraph><paragraph eId="article-13-5"><num>(5)</num><content><p>This article does not apply in relation to any right of way to which section 271 or 272 of the Town and Country Planning Act 1990<authorialNote class="footnote" eId="f00014" marker="14"><p><ref eId="c00028" href="http://www.legislation.gov.uk/id/ukpga/1990/8">1990 c. 8</ref>. eId="article-14-1-a"><num>(a)</num><content><p>no notice to treat is to be served under Part 1 of the <abbr title="Compulsory Purchase Act 1965 c. 56">1965 Act</abbr> as applied to the acquisition of eId="article-14-1-b"><num>(b)</num><content><p>no declaration is to be executed under section 4 of the Compulsory Purchase (Vesting Declarations) Act 1981 as applied by article 5 (application of the Compulsory Purchase (Vesting Declarations) Act 1981).</p></content></level></paragraph><paragraph eId="article-14-2"><num>(2)</num><content><p>The powers conferred by article 8 (temporary use of land
