					<dc:description>This Order confers powers on The Felixstowe Dock and Railway Company for the compulsory acquisition of land and interests in land in the Borough of Ipswich and Suffolk Coastal District, Suffolk. The powers are conferred for the purposes of constructing and operating an additional railway line adjacent to part of the existing Felixstowe branch railway line and improvements to certain level crossings on the existing Felixstowe branch railway line. Such works were authorised by the Felixstowe Branch Line and Ipswich Yard Improvement Order 2008 (S.I. 2008/2512) (“the 2008 Order”). The compulsory acquisition powers conferred by the 2008 Order expired on 14th October 2013.</dc:description>

<Pnumber>1</Pnumber>
<P2para><Text>All private rights of way over land subject to compulsory acquisition under this Order are extinguished—</Text>

<Pnumber>a</Pnumber>

<Text>as from the date of acquisition of the land by <Abbreviation Expansion="The Felixstowe Dock and Railway Company being a company limited by shares and incorporated by The Felixstowe Railway and Pier Act 1875 c. cxlv.">the undertaker</Abbreviation>, whether compulsorily or by agreement; or</Text>

<Text>on the date of entry on the land by the undertaker under section 11(1) (powers of entry) of the <Abbreviation Expansion="Compulsory Purchase Act 1965 c. 56">1965 Act</Abbreviation><FootnoteRef Ref="f00013"/>,</Text>

</P2>
<Text>whichever is the sooner.</Text>

<Pnumber>2</Pnumber>
<P2para>
<Text>In respect of land owned by the undertaker and required for the purposes of this Order all private rights of way are extinguished on the appropriation of the land for any of those purposes by the undertaker.</Text>

<Pnumber>3</Pnumber>
<P2para>
<Text>All private rights of way over land of which the undertaker takes temporary possession under this Order are suspended and unenforceable for as long as the undertaker remains in lawful possession of the land.</Text>
</P2para>

<Pnumber>4</Pnumber>
<P2para>
<Text>Any person who suffers loss by the extinguishment or suspension of any private right of way under this article is entitled to compensation to be determined, in case of dispute, under Part 1 of the <Abbreviation Expansion="Land Compensation Act 1961 c. 33">1961 Act</Abbreviation>.</Text>

<Pnumber>5</Pnumber>

<Text>This article does not apply in relation to any right of way to which section 271 or 272 of the Town and Country Planning Act 1990<FootnoteRef Ref="f00014"/> (extinguishment of rights of statutory undertakers, <Abbreviation Expansion="et cetera" xml:lang="la">etc.</Abbreviation>) or paragraph 2 of Schedule 9 (provisions relating to statutory undertakers, etc.) to the <Abbreviation Expansion="Felixstowe Branch Line and Ipswich Yard Improvement Order 2008 (S.I. 2008/2512)">2008 Order</Abbreviation>, as applied by article 15 (application of provisions of the 2008 Order), applies.</Text>
