The Local Authorities (Goods and Services) (Public Bodies) (England) Order 2014

Coming into force

The Secretary of State for Communities and Local Government and the Secretary of State for Justice make this order jointly in exercise of the powers conferred by sections 1(5) and 1(6) of the Local Authorities (Goods and Services) Act 19701.

Citation, commencement and extent1

This Order may be cited as the Local Authorities (Goods and Services) (Public Bodies) (England) Order 2014 and comes into force on 1st June 2014.

Designation as a public body2

The Community Rehabilitation Companies listed in the Schedule to this Order and the National Probation Service3, being persons appearing to the Secretaries of States to be exercising functions of a public nature, are public bodies for the purposes of section 1 of the Local Authorities (Goods and Services) Act 1970, in its application to England.

Restrictions on agreements which may be entered into3

Any agreement which may be entered into by a body described in article 2 by virtue of this Order is subject to the following restrictions—

a

any such agreement is limited to the supply of legal, occupational health, health and safety, human resources or accounting services only; and

b

any such agreement shall cease to have effect after 30th June 2015.

EXPLANATORY NOTE

(This note is not part of the Order)

Article 3 of this Order designates as public bodies for the purposes of the Local Authorities (Goods and Services) Act 1970 the Community Rehabilitation Companies specified in column (1) of the Schedule to the Order and the National Probation Service. The effect of this designation is to allow local authorities in England to provide certain goods and services to them.

Article 4 imposes restrictions on the agreements for the provision of goods and services that can be made by the bodies designated by this Order. It limits such agreements to the provision of legal, occupational health, health and safety, human resources or accounting services and provides that agreements for such services cannot extend beyond 30 June 2015. A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
