51. In regulation 2 (amendment of the Housing Benefit Regulations 2006) of the Benefit Cap (Housing Benefit) Regulations 2012(1) in paragraph (5), in regulation 75F inserted by those Regulations—
(a)after sub-paragraph (e) insert—
“(ea)the claimant, the claimant’s partner or a young person for whom the claimant or the claimant’s partner is responsible, is receiving a personal independence payment;”;
(b)in sub-paragraph (f) for “or (e)” substitute “, (e) or (ea)”; and
(c)after sub-paragraph (f)(iii) insert—
“(iv)that payment is not payable in accordance with regulations made under section 85 (care home residents) or section 86(1) (hospital in-patients) of the Welfare Reform Act 2012;”.
