The Secretary of State for Education, in exercise of the powers conferred by section 512A of the Education Act 19961, makes the following Order:

Citation and commencement1

This Order may be cited as the Transfer of Functions Concerning School Lunches etc. (England) (Amendment) Order 2013 and comes into force on 1st January 2014.

The Education (Transfer of Functions Concerning School Lunches etc.) (England) (No. 2) Order 19992 is amended as follows.

In article 2(1) delete the words after “each maintained school in England” to the end of the sentence.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Education (Transfer of Functions Concerning School Lunches etc.) (England) (No. 2) Order 1999 so as to provide that the duty to provide school lunches in accordance with section 512(3) and (4) of the Education Act 1996, and the duty to provide school lunches free of charge in accordance with section 512ZB(1) of that Act, is transferred from local authorities to the governing body of each maintained school in England, irrespective of whether the school’s budget share includes a specific amount in respect of meals and other refreshment.

An impact assessment has not been produced for this instrument as it has no impact on businesses, civil society organisations or on the public sector.
