Coming into force
The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 41(1) and (2)(g), 45(1) and (2), 46(1)(j), 49(1) and (2), and 51(1)(h) of the Road Traffic Act 19881 (“the 1988 Act”) and section 2(2) of the European Communities Act 19722 (“the 1972 Act”).
The Secretary of State is a Minister designated for the 1972 Act in relation to—
regulation of the type, description, construction or equipment of vehicles, and of components of vehicles, and in particular any vehicle type approval scheme3; and
testing the roadworthiness of motor vehicles and their trailers4.
Representative organisations have been consulted in accordance with section 195(2)5 of the 1988 Act.
