PART 6Transfer of appeal functions to the Welsh Ministers
Appeal functions: Producer Responsibility Obligations (Packaging Waste) Regulations 200723.
(1)
In regulation 2(2) of the Producer Responsibility Obligations (Packaging Waste) Regulations 200728, the definition of “appropriate authority” is amended as follows.
(2)
In paragraph (d), omit “or the Natural Resources Body for Wales” and the “and” at the end.
(3)
After paragraph (d) insert—
“(da)
for the purposes of any provision in these Regulations relating to the exercise of functions in respect of determining appeals against decisions of the Natural Resources Body for Wales—
(i)
where the decision was made prior to 1st October 2013, the Secretary of State;
(ii)
where the decision was made on or after 1st October 2013, the Welsh Ministers;”.
