PART 6Transfer of appeal functions to the Welsh Ministers
Appeal functions: Waste Electrical and Electronic Equipment Regulations 200622.
(1)
Regulation 66 of the Waste Electrical and Electronic Equipment Regulations 200627 is amended as follows.
(2)
In paragraph (1)—
(a)
for sub-paragraph (a), substitute—
“(a)
to the Secretary of State against—
(i)
a decision of the Environment Agency; or
(ii)
a decision of the Natural Resources Body for Wales made prior to 1st October 2013;”
(b)
after sub-paragraph (a) insert—
“(aa)
to the Welsh Ministers against a decision of the Natural Resources Body for Wales made on or after 1st October 2013;”
(3)
In paragraph (3)—
(a)
for sub-paragraph (a) substitute—
“(a)
to the Secretary of State against—
(i)
a decision of the Environment Agency; or
(ii)
a decision of the Natural Resources Body for Wales made prior to 1st October 2013;”
(b)
after sub-paragraph (a) insert—
“(aa)
to the Welsh Ministers against a decision of the Natural Resources Body for Wales made on or after 1st October 2013.”

In paragraph (5), after sub-paragraph (a) insert—
“(aa)
the Welsh Ministers,”.
