Modification of section 22 of the Act (retention)

11.  Section 22 of the Act(1), as applied by article 3, has effect as if for subsection (5) there were substituted—

“(5) Nothing in this section affects any power of a court to make an order under section 26 of the UK Borders Act 2007(2).”.

Section 22 of the Act was amended by the Criminal Justice Act 2003 (c.44), section 12, Schedule 1, paragraphs 1 and 4.There was another amendment to this section by the Immigration and Asylum Act 1999 (c.33), which is not relevant to this Order.
