The Secretary of State, being a Minister designated F1 for the purposes of section 2(2) of the European Communities Act 1972 F2 in relation to measures relating to rights of entry into, and residence in, the United Kingdom, makes the following Regulations.

Citation and commencement1

These Regulations may be cited as the Immigration (European Economic Area) (Amendment) Regulations 2013 and come into force on 1st July 2013.

Amendments to the Immigration (European Economic Area) Regulations 20062

The Immigration (European Economic Area) Regulations 2006 F3 are amended as follows—

a

in regulation 16 (issue of registration certificate), in paragraph (7), omit “and shall be issued free of charge”;

b

in regulation 17 (issue of residence card), omit paragraph (7);

c

in regulation 18 (issue of a document certifying permanent residence and a permanent residence card), omit paragraph (4); and

d

in regulation 18A (issue of a derivative residence card), in paragraph (4), omit “free of charge and”.

These Regulations amend the Immigration (European Economic Area) Regulations 2006 (S.I. 2006/1003, as amended) to remove the requirements for registration certificates, residence cards, documents certifying permanent residence, permanent residence cards and derivative residence cards issued pursuant to those Regulations to be issued free of charge.

The amendments are consequential to changes introduced by the Immigration and Nationality (Cost Recovery Fees) Regulations 2013 (S.I. 2013/617), which specify the fees to be charged for applications for the above documentation from 1st July 2013.

An impact assessment has not been produced for these Regulations as no impact on businesses, charities, voluntary bodies or the public sector is foreseen.
