The Secretary of State, in exercise of the powers conferred by sections 10 and 93 of the Planning (Listed Buildings and Conservation Areas) Act 19901, makes the following Regulations:
Citation, commencement and application1

These Regulations may be cited as the Planning (Listed Buildings and Conservation Areas) (Amendment) (England) Regulations 2013 and shall come into force on 25th June 2013.

These Regulations apply in relation to England only.
Amendment of the Planning (Listed Buildings and Conservation Areas) Regulations 1990: design and access statements2

The Planning (Listed Buildings and Conservation Areas) Regulations 19902 are amended as follows.

In regulation 3A—
a
in paragraph (1)—
i
for “about” substitute “which explains”;
ii
after sub-paragraph (a) insert—
aa
how the design principles and concepts that have been applied to the works take account of—
i
the special architectural or historic importance of the building;
ii
the particular physical features of the building that justify its designation as a listed building; and
iii
the building’s setting; and
b
delete paragraph (2);
c
in paragraph (3)—
i
at the end of sub-paragraph (c) insert “and”;
ii
in sub-paragraph (d) for “; and” substitute a full stop; and
iii
delete sub-paragraph (e); and
d
delete paragraph (5).
