The Royal Brompton and Harefield NHS Foundation Trust (Transfer of Trust Property) Order 2012

The Secretary of State for Health makes the following Order in exercise of the powers conferred by sections 51(3) and 64(5)(b) of the National Health Service Act 20061.

Citation, commencement and interpretation1.

(1)

This Order may be cited as the Royal Brompton and Harefield NHS Foundation Trust (Transfer of Trust Property) Order 2012 and comes into force on 1st April 2012.

(2)

In this Order—

“the FT” means the Royal Brompton and Harefield NHS Foundation Trust2;
“the new trustee” means the trustee for the Royal Brompton and Harefield NHS Foundation Trust, namely the Royal Brompton and Harefield Charity trustee, a company limited by guarantee under number 77955833; and

“the trust property” means the property specified in the schedule of trust property prepared by, and signed on behalf of, the FT, on 2nd February 2012.

Transfer of trust property2.

(1)

The trust property, and any rights and liabilities arising from that property, are transferred from the FT to the new trustee.

(2)

In any instrument relating to the trust property, any reference to the trustees of the trust property shall be construed as a reference to the new trustee and any reference to the FT as the trustee for the trust property shall be construed as a reference to the new trustee.

(This note is not part of the Order)

This Order transfers trust property held by the Royal Brompton and Harefield NHS Foundation Trust to the trustee appointed for that Trust under section 51(1) of the National Health Service Act 2006 and makes related provision. A copy of the schedule of trust property transferred under this Order can be obtained from the Department of Health, Quarry House, Quarry Hill, Leeds LS2 7UE.
