Article 2(a) and (c) of this Order corrects a drafting defect in the Pensions Act 2007 (Commencement No. 4) Order 2011 (S.I. 2011/1267) (‘the Order’). It provides that the introductory paragraph for amendments made to the Pension Schemes Act 1993 (c.48) in Part 2 of Schedule 4 to the Pensions Act 2007 is commenced in relation to all the provisions containing substantive amendments to the Pension Scheme Act 1993 which are brought into force by that instrument.
Article 2(b) and (d) makes minor technical amendments to the Order to bring into force the repeal of certain provisions specified in Part 7 of Schedule 7 to the Pensions Act 2007. The provisions to be repealed introduce or amend provisions which are omitted by paragraphs 54 and 60(4)(a) of Part 2 of Schedule 4 of that Act, which are brought into force by the Order. The repeal of those provisions removes that amending legislation which no longer has any effect.
This instrument has no impact on the private sector and civil society organisations. However, related legislation reduces costs on the private sector and civil society organisations, and an assessment of the overall impact of the policy has been made. A copy of the impact assessment is available from the libraries of both Houses of Parliament, and is annexed to the Explanatory Memorandum for the Pensions Act 2007 (Abolition of Contracting-out for Defined Contribution Pension Schemes) (Consequential Amendments) Regulations 2011 (S.I. 2011/1245) which is available alongside that instrument on www.legislation.gov.uk.
