<P2para><Text>These Regulations may be cited as the Town and Country Planning (Compensation) (England) Regulations 2012 and shall come into force on 6th April 2012.</Text>

<Text>In these Regulations—</Text>

<Title>Prescribed development</Title>

<Text>For the purposes of paragraphs (2A)(a) and (3C)(a) of section 108 of the Act (compensation where development order or local development order withdrawn), development of the following description is prescribed—</Text>

<Pnumber>a</Pnumber>
<P3para>
<Text>development permitted by Part 1 of Schedule 2 (development within the curtilage of a dwelling house);</Text>
</P3para></P3>

<Pnumber>b</Pnumber>

<Text>development permitted by Class D and Class E of Part 2 of Schedule 2 (minor operations relating to electric vehicle charging points);</Text>
</P3para></P3>

<Text>development permitted by Class I of Part 3 of Schedule 2 (changes of use relating to dwelling houses and houses in multiple occupation);</Text>
</P3para></P3>

<Title>Prescribed manner in which planning permission to be withdrawn</Title>

<Pnumber>3</Pnumber>
<P1para>
<Text>For the purposes of section 108(3C)(b) of the Act, the prescribed manner for withdrawing planning permission is by direction in accordance with articles 4, 5 and (as appropriate) 6 of the GPDO.</Text>
</P1para>
</P1>
</P1group>
<P1group>
<Title>Notice of withdrawal – prescribed manner and period</Title>

<Pnumber>4</Pnumber>
<P1para>
<Text>For the purposes of section 108(3C)(c) of the Act—</Text>

<Text>the prescribed manner in which notice of the withdrawal is to be published is in the manner described in paragraphs (1) to (5) of article 5 of the GPDO; and</Text>

<Title>Notice of withdrawal, revocation, amendment or directions – prescribed manner and period</Title>

<Text>For the purposes of section 108(3D)(c) of the Act—</Text>

<Title>Transitional provision</Title>
<P1 DocumentURI="http://www.legislation.gov.uk/uksi/2012/749/regulation/6/made" IdURI="http://www.legislation.gov.uk/id/uksi/2012/749/regulation/6" id="regulation-6">
<Pnumber>6</Pnumber>
<P1para>
<Text>These Regulations shall not apply in relation to any withdrawal of planning permission for development of a description prescribed in regulation 2(f), where, before 1st December 2011, either—</Text>
<P3 DocumentURI="http://www.legislation.gov.uk/uksi/2012/749/regulation/6/a/made" IdURI="http://www.legislation.gov.uk/id/uksi/2012/749/regulation/6/a" id="regulation-6-a">
<Pnumber>a</Pnumber>

<Text>notice of the direction withdrawing that permission has been given in accordance with article 5(1) of the GPDO, or</Text>
</P3para></P3>

<Text>the direction is one to which article 6 of the GPDO (directions with immediate effect) applies and the direction has come into force.</Text>

<Title>Revocation</Title>

<P><Text>Section 108 of the Town and Country Planning Act 1990 provides for the payment of compensation in certain cases where planning permission for development granted by a development order or a local development order is withdrawn and where on an application for planning permission for that development, the application is refused or permission is granted subject to conditions.</Text></P>
<P><Text Hanging="indented">Section 108(2A) and (3A) to (3D) (inserted by section 189 of the Planning Act 2008) limits the circumstances in which compensation is payable. These Regulations prescribe types of development for the purposes of section 108(2A) and (3C) (regulation 2), prescribe the manner in which planning permission is to be withdrawn (regulation 3) and prescribe the manner, and maximum period, in which notice of withdrawal, revocation, amendment or directions is to be given (regulations 4 and 5). The prescribed development now includes the installation of non-domestic microgeneration equipment. Regulation 6 makes transitional provision.</Text></P>
