<Title>Citation and commencement</Title>

<Text>This Order may be cited as the Standards Board for England (Abolition) Order 2012 and comes into force on 1st April 2012.</Text>

<Title>Interpretation</Title>

<Text>In this Order—</Text>

<Para><Text>“the <Abbreviation Expansion="1st April 2012">abolition date</Abbreviation>” means 1st April 2012; and</Text>
</Para>
</ListItem>
<ListItem>
<Para><Text>“<Abbreviation Expansion="Standards Board for England">the Board</Abbreviation>” means the Standards Board for England.</Text>
</Para>
</ListItem>

<P1group>
<Title>Transfer of property, rights and liabilities of the Standards Board for England</Title>

<Pnumber>3</Pnumber>

<Pnumber>1</Pnumber>
<P2para><Text>On the abolition date, subject to articles 4 to 6—</Text>
<P3 DocumentURI="http://www.legislation.gov.uk/uksi/2012/668/article/3/1/a/made" IdURI="http://www.legislation.gov.uk/id/uksi/2012/668/article/3/1/a" id="article-3-1-a">
<Pnumber>a</Pnumber>
<P3para>
<Text>all property of the Board transfers to the ownership of the Secretary of State;</Text>
</P3para></P3>
<P3 DocumentURI="http://www.legislation.gov.uk/uksi/2012/668/article/3/1/b/made" IdURI="http://www.legislation.gov.uk/id/uksi/2012/668/article/3/1/b" id="article-3-1-b">
<Pnumber>b</Pnumber>
<P3para>
<Text>all rights and liabilities of the Board transfer to and vest in the Secretary of State; and</Text>
</P3para></P3>

<Pnumber>c</Pnumber>

<Text>any reference to the Board in an instrument or document in respect of anything transferred is to be treated as a reference to the Secretary of State.</Text>

<Text>The Secretary of State may issue a certificate confirming that property has transferred from the Board to the Secretary of State, which is conclusive evidence that the property has been so transferred.</Text>

<Title>Termination of contracts of employment</Title>

<P2para><Text>Any contract of employment relating to an employee of the Board existing at the abolition date, terminates on that date.</Text>

<Text>Anything done before the abolition date by, or in relation to, the Board in respect of an employee or the contract of employment of an employee, is deemed to have been done by, or in relation to, the Secretary of State.</Text>

<Title>Termination of appointments</Title>

<P2para><Text>The terms of appointment of any members of the Board holding office at the abolition date, terminate on that date.</Text>

<Text>Anything done before the abolition date by, or in relation to, the Board in respect of a member of the Board or the terms of appointment of that member, is deemed to have been done by, or in relation to, the Secretary of State.</Text>

<Title>Proceedings before the First-tier Tribunal</Title>

<P2para><Text>If immediately before the abolition date the Board is a party to—</Text>

<Pnumber>a</Pnumber>

<Text>proceedings before the First-tier Tribunal on a referral under section 64(3)(b) or 65(4)<FootnoteRef Ref="f00002"/> of the Local Government Act 2000, or</Text>

<Text>the Secretary of State is, from the abolition date, substituted for the Board as a party to the proceedings; and anything done by or in relation to the Board in connection with the proceedings is to be treated as having been done by or in relation to the Secretary of State.</Text>

<P><Text>This Order makes provision in connection with the abolition of the Standards Board for England (‘the Board’) on the abolition date of 1st April 2012.</Text></P>
<P><Text>Article 3 transfers all property, rights and liabilities from the Board to the Secretary of State.</Text></P>
<P><Text>Article 4 terminates the employment contracts of staff of the Board, and article 5 terminates the terms of appointment of members of the Board.</Text></P>
<P><Text>Article 6 substitutes the Secretary of State for the Board in respect of certain ongoing legal proceedings.</Text></P>
<P><Text>An impact assessment has not been produced for this instrument as no impact on business or the private or voluntary sectors is foreseen.</Text></P>
