The Common Agricultural Policy Single Payment and Support Schemes (Amendment) Regulations 2012

The Secretary of State is designated1 for the purposes of section 2(2) of the European Communities Act 19722 in relation to the common agricultural policy of the European Union and makes these Regulations in exercise of the powers conferred by that section.

Citation and commencement1.

These Regulations may be cited as the Common Agricultural Policy Single Payment and Support Schemes (Amendment) Regulations 2012 and come into force on 1st January 2013.

Amendment of the Common Agricultural Policy Single Payment and Support Schemes Regulations 20102.

The Common Agricultural Policy Single Payment and Support Schemes Regulations 20103 are amended as follows.

For regulation 8 substitute—

“Additional modulation8.

The rates in the third column of the Schedule are the voluntary modulation referred to in Article 1 of Council Regulation (EC) No 378/2007 laying down rules for voluntary modulation of direct payments provided for in Regulation (EC) No 1782/20034 for the period 2009 to 2012 and the voluntary adjustment referred to in Article 10b of Council Regulation (EC) No 73/20095 for 20136.”.

Revocation3.

The Common Agricultural Policy Single Payment and Support Schemes (Reductions from Payments) (England) Regulations 20067 are revoked.

EXPLANATORY NOTE
(This note is not part of the Regulations)

These Regulations amend the Common Agricultural Policy Single Payment and Support Schemes Regulations 2010 (S.I. 2010/540) (“the principal Regulations”) which make provision in England for the administration of Council Regulation (EC) No 73/2009 (OJ No L 30, 31.1.2009, p 16), and other associated EU instruments, in relation to direct support schemes under the common agricultural policy.

Regulation 2 amends the principal Regulations to provide for additional modulation deductions which will be made from direct payments to farmers for 2013.

Regulation 3 revokes the Common Agricultural Policy Single Payment and Support Schemes (Reductions from Payments) (England) Regulations 2006 (S.I. 2006/169).

A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sectors is foreseen.
