3. At the end of section 166 of the Employment Rights Act 1996 (unpaid redundancy payments: applications to the Secretary of State)(1) insert—
“(9) In this section—
(a)references to a company are to be read as including references to a charitable incorporated organisation, and
(b)any reference to the Insolvency Act 1986 in relation to a company is to be read as including a reference to that Act as it applies to charitable incorporated organisations.”.
1996 c.18. Section 166 was amended by the Employment Rights (Dispute Resolution) Act 1998 (c.8), sections 1(2) and 11(2) and Schedule 2, and by the Enterprise Act 2002, Schedule 17, paragraph 49 and Schedule 26. There are other amendments to section 166 not relevant to this Order.
