2001/3649</ref> and prospectively by paragraph 131 of Schedule 16 to the Police Reform and Social Responsibility Act 2011.</p></authorialNote>.</p><formula name="enactingText"><p>In accordance with commencement and extent</heading><num>1.</num><paragraph eId="regulation-1-1"><num>(1)</num><content><p>These Regulations may be cited as the Police Pensions (Amendment <abbr title="Number">No.</abbr> 2) Regulations 2012.</p></content></paragraph><paragraph eId="regulation-1-2"><num>(2)</num><content><p>These Regulations come into force on 3rd December 2012.</p></content></paragraph><paragraph eId="regulation-1-3"><num>(3)</num><content><p>These Regulations extend to England and Wales.</p></content></paragraph></hcontainer><hcontainer name="regulation" eId="regulation-2"><heading>Interpretation</heading><num>2.</num><intro><p>In these Regulations—</p></intro><hcontainer name="definition"><content><p>“the <abbr title="Police Pensions Regulations 1987 eId="regulation-3"><heading>Compulsory retirement on grounds of efficiency: relevant considerations</heading><num>3.</num><paragraph eId="regulation-3-1"><num>(1)</num><content><p><mod>In regulation A19 of the <abbr title="Police Pensions Regulations 1987 (S.I. 1987/257)">1987 Regulations</abbr> (compulsory retirement on grounds of efficiency of the force), after paragraph (2) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><paragraph><num>(3)</num><intro><p>In making a determination under paragraph (2), a police pension authority shall take account of—</p></intro><level class="para1"><num>(a)</num><content><p>the desirability of retaining in the force regular policemen who possess skills or knowledge of particular importance; and</p></content></level><level class="para1"><num>(b)</num><content><p>the standard or level to which the regular policeman in question has performed the duties of his rank or role.</p></content></level></paragraph></quotedStructure><inline name="appendText">.</inline></mod></p></content></paragraph><paragraph eId="regulation-3-2"><num>(2)</num><content><p><mod>In regulation 20 of the <abbr title="Police Pensions Regulations 2006 (S.I. 2006/3415)">2006 Regulations</abbr> (compulsory retirement on grounds of efficiency of the force), after paragraph (2) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><paragraph><num>(2A)</num><intro><p>In making a determination under paragraph (2), a police pension authority shall take account of—</p></intro><level class="para1"><num>(a)</num><content><p>the desirability of retaining in the force regular policemen who possess skills or knowledge of particular importance; and</p></content></level><level eId="regulation-4"><heading>Senior officers: delayed payment of ordinary pension</heading><num>4.</num><paragraph eId="regulation-4-1"><num>(1)</num><content><p>The <abbr title="Police Pensions Regulations 1987 (S.I. 1987/257)">1987 Regulations</abbr> are amended as follows.</p></content></paragraph><paragraph eId="regulation-4-2"><num>(2)</num><intro><p>In regulation B1 (policeman’s ordinary pension)—</p></intro><level class="para1" eId="regulation-4-2-a"><num>(a)</num><content><p>in paragraph (5), omit the words after “of that Schedule”;</p></content></level><level class="para1" eId="regulation-4-2-b"><num>(b)</num><content><p><mod>after paragraph (5) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="unknown" uk:docName="unknown" ukl:TargetClass="unknown" ukl:TargetSubClass="unknown" ukl:Context="unknown" ukl:Format="double"><paragraph><num>(5A)</num><content><p>In the case of a person entitled to reckon less than 30 years’ pensionable service, no payments shall be made on account of an ordinary pension in respect of the period (if any) after his retirement and before he has attained the age of 50 years or, if he sooner becomes permanently disabled and he is not ineligible under regulations G7 and G8 for a pension award payable on the grounds of permanent disablement, before he becomes so disabled.</p></content></paragraph><paragraph><num>(5B)</num><content><p>In the case of a regular policeman above the rank of chief superintendant who gives notice in writing to the police pension authority that he wishes this paragraph to apply to him, no payments shall be made on account of an ordinary pension in respect of the period after his retirement and before he has attained the normal minimum pension age, as defined in section 279(1) of the Finance Act 2004<authorialNote class="footnote" eId="f00006" marker="6"><p><ref eId="c00043" href="http://www.legislation.gov.uk/id/ukpga/2004/12">2004 c. 12</ref>. This implements recommendation 57 in the Report.</p></blockContainer><blockContainer ukl:Name="P"><p>Regulation 4 of these Regulations amends regulation B1 of the <abbr title="Police Pensions Regulations 1987 (S.I. 1987/257)">1987 Regulations</abbr> in order to allow a senior police officer to defer payment of a pension until the officer reaches normal minimum pension age. No such amendment is necessary in respect of the <abbr title="Police Pensions Regulations 2006 (S.I. 2006/3415)">2006 Regulations</abbr>.
