The Secretary of State, in exercise of powers conferred by section 128(2) of the Serious Organised Crime and Police Act 2005(1), makes the following Order:
1.—(1) This Order may be cited as the Serious Organised Crime and Police Act 2005 (Designated Sites under Section 128) (Amendment No. 2) Order 2012 and shall come into force on the day after the day on which it has been laid before Parliament.
(2) This Order extends to England and Wales only.
2.—(1) The Serious Organised Crime and Police Act 2005 (Designated Sites under Section 128) Order 2007(2) is amended as follows.
(2) In article 2(1)(g), for “the sites described in paragraphs (2) to (11)” substitute “the sites described in paragraphs (2) to (12)”.

This Order amends the Serious Organised Crime and Police Act 2005 (Designated Sites under Section 128) Order 2007 to ensure that article 2(1)(g) covers the site mentioned in paragraph (12) of that article. The consequence of this is that the site is clearly designated under section 128 of the Serious Organised Crime and Police Act 2005 so that if a person enters on it as a trespasser, he will commit an offence under section 128(1) of that Act. Article 2(12) of the Serious Organised Crime and Police Act 2005 (Designated Sites under Section 128) Order 2007 was inserted into that Order by the Serious Organised Crime and Police Act 2005 (Designated Sites under Section 128) (Amendment) Order 2012.
