and</p></content></level><level class="para1" eId="article-21-1-e"><num>(e)</num><content><p>enter on the land for the purpose of exercising the powers conferred by sub-paragraphs (a) to (d).</p></content></level></paragraph><paragraph eId="article-21-2"><num>(2)</num><content><p>No land may be entered or equipment placed or left on or removed from the land under paragraph (1), unless at least 7 days’ notice has been served on every owner and occupier of the land.</p></content></paragraph><paragraph eId="article-21-3"><num>(3)</num><intro><p>Any person entering land under this article on behalf of <abbr title="The Chiltern Railway Company Limited (Company No. 3007939) whose registered office is at Great Central House, Marylebone Station, Melcombe Place, London NW1 6JJ">the Company</abbr>—</p></intro><level class="para1" eId="article-21-3-a"><num>(a)</num><content><p>must, if so required, before or after entering the land produce written evidence of authority to do so; and</p></content></level><level class="para1" eId="article-21-3-b"><num>(b)</num><content><p>may take onto the land such vehicles and equipment as are necessary to carry out the survey or investigation or to make the trial holes.</p></content></level></paragraph><paragraph eId="article-21-4"><num>(4)</num><intro><p>No trial holes are to be made under this article—</p></intro><level class="para1" eId="article-21-4-a"><num>(a)</num><content><p>in a carriageway or footway without the consent of the highway authority; or</p></content></level><level class="para1" eId="article-21-4-b"><num>(b)</num><content><p>in a private street without the consent of the street authority,</p></content></level></paragraph></hcontainer><hcontainer name="wrapper2"><intro><p>but such consent must not be unreasonably withheld.</p></intro><paragraph eId="article-21-5"><num>(5)</num><content><p>The Company must compensate the owners and occupiers of the land for any loss or damage arising by reason of the exercise of the powers conferred by this article, such compensation to be determined, in case of dispute, under Part 1 of the <abbr title="Land Compensation Act 1961 c. 33">1961 Act</abbr>.</p></content></paragraph><paragraph eId="article-21-6"><num>(6)</num><content><p>Nothing in this article obviates the need to obtain scheduled monument consent under the Ancient Monuments and Archaeological Areas Act 1979<authorialNote class="footnote" eId="f00021" marker="21"><p><ref eId="c00025" href="http://www.legislation.gov.uk/id/ukpga/1979/46">1979 c. 46</ref>.</p></authorialNote>.</p></content></paragraph><paragraph eId="article-21-7"><num>(7)</num><content><p>If either a highway authority or a street authority fails to notify <abbr title="The Chiltern Railway Company Limited (Company No. 3007939) whose registered office is at Great Central House, Marylebone Station, Melcombe Place, London NW1 6JJ">the Company</abbr> of its decision within 14 days of receiving an application for consent under paragraph (4), that authority is deemed to have granted consent.</p></content></paragraph></hcontainer></article></hcontainer></part></body></act></akomaNtoso>
