and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2012/2421/schedule/1/paragraph/1/2/b" IdURI="http://www.legislation.gov.uk/id/uksi/2012/2421/schedule/1/paragraph/1/2/b" id="schedule-1-paragraph-1-2-b"><Pnumber>b</Pnumber><P3para><Text>every part of the land can be reached from the residence without having to cross land which is not owned by that single owner.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2012/2421/schedule/1/paragraph/1/3" IdURI="http://www.legislation.gov.uk/id/uksi/2012/2421/schedule/1/paragraph/1/3" id="schedule-1-paragraph-1-3"><Pnumber>3</Pnumber><P2para><Text>Sub-paragraph (2)(b) is satisfied where a part of the land cannot be reached from the residence by reason only of intervening land in other ownership on which there is a road, railway, river or canal, provided that the additional requirement in sub-paragraph (4) is met.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2012/2421/schedule/1/paragraph/1/4" IdURI="http://www.legislation.gov.uk/id/uksi/2012/2421/schedule/1/paragraph/1/4" id="schedule-1-paragraph-1-4"><Pnumber>4</Pnumber><P2para><Text>The additional requirement referred to in sub-paragraph (3) is that it is reasonable to think that sub-paragraph (2)(b) would be satisfied if the intervening land were to be removed leaving no gap.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/uksi/2012/2421/schedule/1/paragraph/1/5" IdURI="http://www.legislation.gov.uk/id/uksi/2012/2421/schedule/1/paragraph/1/5" id="schedule-1-paragraph-1-5"><Pnumber>5</Pnumber><P2para><Text>Land which falls within sub-paragraph (1) may be listed if—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2012/2421/schedule/1/paragraph/1/5/a" IdURI="http://www.legislation.gov.uk/id/uksi/2012/2421/schedule/1/paragraph/1/5/a" id="schedule-1-paragraph-1-5-a"><Pnumber>a</Pnumber><P3para><Text>the residence is a building that is only partly used as a residence; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2012/2421/schedule/1/paragraph/1/5/b" IdURI="http://www.legislation.gov.uk/id/uksi/2012/2421/schedule/1/paragraph/1/5/b" id="schedule-1-paragraph-1-5-b"><Pnumber>b</Pnumber><P3para><Text>but for that residential use of the building, the land would be eligible for listing.</Text></P3para></P3></P2para></P2></P1para></P1><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2012/2421/schedule/1/paragraph/2" IdURI="http://www.legislation.gov.uk/id/uksi/2012/2421/schedule/1/paragraph/2" id="schedule-1-paragraph-2" TerritorialApplication="E" RestrictExtent="E+W" RestrictStartDate="2012-09-21"><Pnumber><CommentaryRef Ref="key-a7880a2431de3ef4b5455c0e45ba7f6c"/>2</Pnumber><P1para><Text>For the purposes of paragraph 1 and this paragraph—</Text><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2012/2421/schedule/1/paragraph/2/a" IdURI="http://www.legislation.gov.uk/id/uksi/2012/2421/schedule/1/paragraph/2/a" id="schedule-1-paragraph-2-a"><Pnumber>a</Pnumber><P3para><Text>“residence” means a building used or partly used as a residence;</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2012/2421/schedule/1/paragraph/2/b" IdURI="http://www.legislation.gov.uk/id/uksi/2012/2421/schedule/1/paragraph/2/b" id="schedule-1-paragraph-2-b"><Pnumber>b</Pnumber><P3para><Text>a building is a residence if—</Text><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2012/2421/schedule/1/paragraph/2/b/i" IdURI="http://www.legislation.gov.uk/id/uksi/2012/2421/schedule/1/paragraph/2/b/i" id="schedule-1-paragraph-2-b-i"><Pnumber>i</Pnumber><P4para><Text>it is normally used or partly used as a residence, but for any reason so much of it as is normally used as a residence is temporarily unoccupied;</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2012/2421/schedule/1/paragraph/2/b/ii" IdURI="http://www.legislation.gov.uk/id/uksi/2012/2421/schedule/1/paragraph/2/b/ii" id="schedule-1-paragraph-2-b-ii"><Pnumber>ii</Pnumber><P4para><Text>it is let or partly let for use as a holiday dwelling;</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2012/2421/schedule/1/paragraph/2/b/iii" IdURI="http://www.legislation.gov.uk/id/uksi/2012/2421/schedule/1/paragraph/2/b/iii" id="schedule-1-paragraph-2-b-iii"><Pnumber>iii</Pnumber><P4para><Text>it, or part of it, is a hotel or is otherwise principally used for letting or licensing accommodation to paying occupants; or</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2012/2421/schedule/1/paragraph/2/b/iv" IdURI="http://www.legislation.gov.uk/id/uksi/2012/2421/schedule/1/paragraph/2/b/iv" id="schedule-1-paragraph-2-b-iv"><Pnumber>iv</Pnumber><P4para><Text>it is a house in multiple occupation as defined in section 77 of the Housing Act 2004<FootnoteRef Ref="f00013"/>; and</Text></P4para></P4></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/uksi/2012/2421/schedule/1/paragraph/2/c" IdURI="http://www.legislation.gov.uk/id/uksi/2012/2421/schedule/1/paragraph/2/c" id="schedule-1-paragraph-2-c"><Pnumber>c</Pnumber><P3para><Text>a building or other land is not a residence if—</Text><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2012/2421/schedule/1/paragraph/2/c/i" IdURI="http://www.legislation.gov.uk/id/uksi/2012/2421/schedule/1/paragraph/2/c/i" id="schedule-1-paragraph-2-c-i"><Pnumber>i</Pnumber><P4para><Text>it is land on which currently there are no residences but for which planning permission or development consent has been granted for the construction of residences;</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2012/2421/schedule/1/paragraph/2/c/ii" IdURI="http://www.legislation.gov.uk/id/uksi/2012/2421/schedule/1/paragraph/2/c/ii" id="schedule-1-paragraph-2-c-ii"><Pnumber>ii</Pnumber><P4para><Text>it is a building undergoing construction where there is planning permission or development consent for the completed building to be used as a residence, but construction is not yet complete; or</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/uksi/2012/2421/schedule/1/paragraph/2/c/iii" IdURI="http://www.legislation.gov.uk/id/uksi/2012/2421/schedule/1/paragraph/2/c/iii" id="schedule-1-paragraph-2-c-iii"><Pnumber>iii</Pnumber><P4para><Text>it was previously used as a residence but is in future to be used for a different purpose and planning permission or development consent for a change of use to that purpose has been granted.</Text></P4para></P4></P3para></P3></P1para></P1><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2012/2421/schedule/1/paragraph/3" IdURI="http://www.legislation.gov.uk/id/uksi/2012/2421/schedule/1/paragraph/3" id="schedule-1-paragraph-3" TerritorialApplication="E" RestrictExtent="E+W" RestrictStartDate="2012-09-21"><Pnumber><CommentaryRef Ref="key-7c78e4015b9d95cec3b15f1896e1d692"/>3</Pnumber><P1para><Text>Land in respect of which a site licence is required under Part 1 of the Caravan Sites and Control of Development Act 1960<FootnoteRef Ref="f00014"/>, or would be so required if paragraphs 1, 4, 5 and 10 to 11A of Schedule 1 to that Act were omitted.</Text></P1para></P1><P1 DocumentURI="http://www.legislation.gov.uk/uksi/2012/2421/schedule/1/paragraph/4" IdURI="http://www.legislation.gov.uk/id/uksi/2012/2421/schedule/1/paragraph/4" id="schedule-1-paragraph-4" TerritorialApplication="E" RestrictExtent="E+W" RestrictStartDate="2012-09-21"><Pnumber><CommentaryRef Ref="key-306d77db0c9625c6d9d506c3863b27bc"/>4</Pnumber><P1para><Text>Operational land as defined in section 263 of the Town and Country Planning Act 1990<FootnoteRef Ref="f00015"/>.</Text></P1para></P1></ScheduleBody></Schedule></Schedules></Secondary><Footnotes><Footnote id="f00013">
