eId="article-1-1"><num>(1)</num><content><p>This Order may be cited as the Protection of Freedoms Act 2012 (Relevant Official Records) Order 2012 and comes into force on 1st October 2012.</p></content></paragraph><paragraph eId="article-1-2"><num>(2)</num><intro><p>In this Order—</p></intro><hcontainer name="definition"><content><p>“<abbr title="Protection of Freedoms Act 2012 c. 9">the Act</abbr>” means the Protection of Freedoms Act 2012;</p></content></hcontainer><hcontainer name="definition"><intro><p>“service police force” means—</p></intro><level class="para1"><num>(a)</num><content><p>the Royal Navy Police;</p></content></level><level class="para1"><num>(b)</num><content><p>the Royal Military Police; or</p></content></level><level eId="article-2"><heading>Relevant official records</heading><num>2.</num><intro><p>Relevant official records for the purposes of section 95 of <abbr title="Protection of Freedoms Act 2012 c. 9">the Act</abbr> are any of the following which are relevant to any application under section 92 of <abbr title="Protection of Freedoms Act 2012 c. 9">the Act</abbr>—</p></intro><level class="para1" eId="article-2-a"><num>(a)</num><content><p>records kept locally by a police force for the use of constables;</p></content></level><level class="para1" eId="article-2-b"><num>(b)</num><content><p>records kept locally by the British Transport Police for the use of constables;</p></content></level><level class="para1" eId="article-2-c"><num>(c)</num><content><p>records kept by the Ministry of Defence Police for the use of constables;</p></content></level><level class="para1" eId="article-2-d"><num>(d)</num><content><p>records kept by the Royal Navy Police for the use of members of a service police force;</p></content></level><level class="para1" eId="article-2-e"><num>(e)</num><content><p>records kept by the Royal Military Police for the use of members of a service police force;</p></content></level><level class="para1" eId="article-2-h"><num>(h)</num><content><p>records of the Crown Court kept by Her Majesty’s Courts and Tribunals Service.</p></content></level></article><article eId="article-3"><heading>Relevant data controllers</heading><num>3.</num><intro><p>The following are prescribed as the relevant data controller in relation to the relevant official records—</p></intro><level class="para1" eId="article-3-a"><num>(a)</num><content><p>the chief officer of police of a police force in England and Wales in relation to the records kept locally by that force for the use of constables;</p></content></level><level class="para1" eId="article-3-b"><num>(b)</num><content><p>the chief constable of the British Transport Police in relation to the records kept locally by the British Transport Police for the use of constables;</p></content></level><level class="para1" eId="article-3-c"><num>(c)</num><content><p>the chief constable of the Ministry of Defence Police in relation to the records kept by the Ministry of Defence Police for the use of constables;</p></content></level><level class="para1" eId="article-3-d"><num>(d)</num><content><p>the Provost Marshal for Courts and Tribunals Service.</p></content></level></article><article eId="article-4"><heading>Annotation of relevant official records</heading><num>4.</num><intro><p>The following records are relevant official records in relation to which a notice to delete details means a notice to record the official record with the details of the disregarded conviction or caution concerned in accordance with section 95 of <abbr title="Protection of Freedoms Act 2012 c. 9">the Act</abbr>—</p></intro><level class="para1" eId="article-4-a"><num>(a)</num><content><p>any records forming part of the names database which are not held electronically; and</p></content></level><level class="para1" eId="article-4-b"><num>(b)</num><content><p>relevant official records referred to in article When an application is successful, section 95 provides that the Secretary of State shall direct the relevant data controller of relevant official records to delete those records. Article 2 of this Order prescribes which official records, in addition to the names database, are relevant official records for this purpose. Article 3 prescribes the relevant data controllers in relation to those relevant official records. Article 4 makes provision, in accordance with section 95 of <abbr title="Protection of Freedoms Act 2012 c. 9">the Act</abbr>, for records to be annotated rather than deleted.</p></blockContainer></blockContainer></conclusions></act></akomaNtoso>
